(2) Mr. Gilley stated the sales tax through <br />August year-to-date is up 30.2%. (3) Mr. Gilley stated the city <br />recently received a grant to participate in low income housing. <br />Balcones Banc Savings Association has made application to <br />participate in this program for ten homes. The City will contract <br />with a non-profit corporation and mortgages would be through <br />Balcones. (4) Mr~ Gilley stated on Friday, October 18, the 1991 <br />City Manager for the Day will be Wendell Harris of SMEU and will <br />begin with a reception in the Council Chambers at 8:30 a.m. <br /> <br />Mayor Morris introduced the City Attorney's Report. Mr. Taylor had <br />no report at this meeting. <br /> <br />Mayor Morris introduced the City Council's Report. (1) Mayor <br />Morris attended a FAIR-NLC Meeting in Washington, D.C. and stated it <br />was a good meeting. She requested the city Manager review <br />information regarding Gasby and MUFBA. (2) The city Council <br />requested information from the City Manager regarding the permit <br />process for trucks emptying their tanks at the wastewater treatment <br />plant. <br /> <br />Mayor Morris introduced for consideration an Executive Session <br />pursuant to Article 6252-17, sections 2(e) and (g), V.A.C.S., to <br />discuss pending litigation (Sierra Club vs. Manual Lujan; in Re: <br />David McKee), contemplated litigation and matters where the duty of <br />the City Attorney to the city pursuant to the Code of Professional <br />Responsibility of the State Bar of Texas clearly conflicts with <br />Article 6252-17; and duties of public officers (Council Members) - <br />expense reimbursement policy, respectively. Mr. Guerra moved to <br />adjourn into Executive Session at 9:40 p.m. and Mr. Hernandez <br />seconded the motion, which passed unanimously. <br /> <br />Ms. Kissler moved to reconvene at 11:23 p.m. and Mr. Moore seconded <br />the motion, which passed unanimously. <br /> <br />Mayor Morris introduced for consideration adoption of a Resolution, <br />the caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, ADOPTING PROCEDURES FOR THE REIMBURSEMENT OF COUNCIL <br />MEMBER EXPENSES PURSUANT TO SECTION 3.04 OF THE SAN MARCOS CITY <br />CHARTER; REPEALING PREVIOUS REQUIREMENTS ON THIS SUBJECT AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />Ms. Kissler moved for adoption of the Resolution and Mr. Moore <br />seconded the motion. Mayor Morris moved to amend the Resolution in <br />Part 1.4. to delete a portion of the sentence (delete and the <br />results of the travel) and Mr. Moore seconded the motion, which <br />passed unanimously (Mr. Guerra not present to vote on this item or <br />for the remainder of this meeting). Mayor Morris moved to amend the <br />reimbursement form to read "expense and mileage reimbursement form," <br />and Mr. Moore seconded the motion, which passed unanimously. The <br />Council then voted unanimously for adoption of the Resolution. <br /> <br />Mayor Morris introduced for consideration adoption of a Resolution, <br />the caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING THE TERMS AND CONDITIONS OF AN AGREEMENT <br />BETWEEN THE CITY AND DAVIDSON, TROILO & BOOTH FOR LEGAL <br />SERVICES IN CONNECTION WITH THE CLOSED CITY LANDFILL SITE; <br />AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT ON BEHALF <br />OF THE CITY; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Ms. Kissler moved for adoption of the Resolution and Mr. Moore <br />seconded the motion. Mr. Gilley advised the Council the maximum <br />expenditure would be $4,500.00. The Council voted unanimously for <br />adoption of the Resolution. <br />
