3 Regular Meeting November 4, 1991 Page 3 Mayor Morris announced the public hearing had been advertised in the newspaper on two occasions, and although the agenda did not cite a public hearing would be held, she opened the public hearing to receive public input. No one wished to speak, so Mayor Morris closed the public hearing. Ms. Kissler moved for adoption of the Ordinance on emergency and Mr. Guerra seconded the motion. Mayor Morris moved to amend the Ordinance in Section 2.(a) to change twenty-first (21st) day to twentieth (20th) day and Mr. Hernandez seconded the motion, which passed unanimously. Mayor Morris moved to amend Exhibit "A" under PAYMENT to change twenty-first (21st) day to twentieth (20th) day and Mr. Moore seconded the motion, which passed unanimously. The Council directed staff bring a progress report to the Council in three months. The Council voted unanimously for adoption of the Ordinance on emergency. Mayor Morris introduced for consideration adoption of an Ordinance on emergency, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE CITY BUDGET ORDINANCE FOR THE 1991-1992 FISCAL YEAR TO PROVIDE FUNDING FOR DRAINAGE CULVERT REPAIRS ON SAN MARCOS PARKWAY; AND DECLARING AN EMERGENCY. Ms. Kissler moved for adoption of the Ordinance on emergency and Mr. Moore seconded the motion. The Council was advised the State had advised the city part of the culvert has eroded. We have closed the street and need to make repairs by replacing the culverts. The Council requested ownership of the street be determined. The Council voted unanimously for adoption of the Ordinance on emergency. Mr. Gilley stated this was for the purchase of hand-held electronic meter reading devices, which information will automatically go into our computer system for billing purposes. Mayor Morris introduced for consideration adoption of a Resolution, the caption which was read as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF AN AGREEMENT BETWEEN THE CITY AND FOR EMERGENCY REPLACEMENT OF CULVERTS ON SAN MARCOS PARKWAY; AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT ON BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE DATE.
