Consider adoption on second and final reading of Ordinance 2009-73, amending <br />various sections of the Land Development Code as follows: amending Chapter 1 by <br />clarifying procedures for approval of development applications, updating definitions, <br />clarifying and modifying procedures for establishment of historic districts and landmarks, <br />clarifying and modifying procedures for issuance of a certificate of appropriateness related <br />to activities in historic districts or involving historic landmarks and clarifying procedures <br />for approval of site preparation permits; amending Chapter 4 by designating setback <br />requirements for lots of one or more acres in SF-R districts; amending Chapter 5 by <br />reconciling procedures for establishment of historic districts with the procedures in <br />• Chapter 1, updating the list of historic districts and landmarks in the city, modifying the <br />criteria and procedures for making a determination of demolition by neglect of historic <br />structures and landmarks, clarifying storm water runoff detention requirements, changing <br />the requirements for preservation of natural features and construction in flood hazard <br />areas, eliminating superfluous language regarding tree protection standards and <br />modifying the requirements for which areas of a property must be maintained in a natural <br />state; amending Chapter 6 by defining what is a fence, requiring permits for fences and <br />adding restrictions for fencing in public easements and certain residential and non- <br />residential areas and adding parking requirements for gyms; amending Chapter 7 by <br />adding requirements for the extension of wastewater lines, creating an option for payment <br />of parkland dedication fee in an MU district before issuance of a residential building <br />permit; amending Chapter 8 by revising definitions applicable to zoning; providing a <br />savings clause; providing for the repeal of any conflicting provisions; and providing an <br />effective date. <br />11. Consider adoption on second and final reading of Ordinance 2009-74, amending <br />Chapter 55, Municipal Court, Section 55.04, Powers and Duties of Municipal Court Judge, <br />by acknowledging the power of the Municipal Court Judge to conduct wedding ceremonies <br />and establishing a fee therefor; providing a savings clause; providing for the repeal of any <br />conflicting provisions; providing for publication; and providing an effective date. <br />12. Consider adoption of Resolution 2009-162R, approving a contract between the City and <br />Hays County for the City's provision of public library services to Hays County residents; <br />i authorizing the City Manager to execute the contract on behalf of the City; and declaring
