Couch to approve the Consent Agenda, less items 13, 14 and 16. The motion carried unanimously. (13)MOTION: Upon a motion made by Councilmember Jones and a second by Councilmember Couch, the City Council voted seven (7) for and none (0) opposed, to adopt Resolution 2009- 163R, as previously captioned. The motion carried unanimously. (14) MOTION: Upon a motion made by Councilmember Porterfield and a second by Councilmember Thomaides, the City Council voted six (6) for and none (0) opposed, with Councilmember Jones abstaining, to adopt Resolution 2009-164$, as previously captioned. The motion carried. (16) MOTION: Upon a motion made by Councilmember Couch and a second by Councilmember Porterfield, the City Council voted four (4) for and three (3) opposed, with Councilmembers Thomaides, Bose and Porterfield voting against, to adopt Resolution 2009- 166R, as previously captioned. The motion carried. Public Hearings 20. Public Hearing to receive comments for and against relief from the requirement to construct public sidewalks on Veramendi, Quarry, and Prospect Streets at 1132 Belvin Street in conjunction with platting or development of property. Mayor Narvaiz opened the public hearing. Joe Schneider stated he feels these sidewalks should 0 t:1 be built, or they should pay the City to have them built. There being no further comments, Mayor Narvaiz closed the Public Hearing. Non-Consent Agenda 21. Consider Ordinance 2009-75, on emergency, amending the City's 2009-2010 budget to authorize the expenditure of funds from the liability insurance fund for professional services; declaring an emergency and providing an effective date. MOTION: Upon a motion made by Councilmember Jones and a second by Councilmember Porterfield, the City Council voted six (6) for and none (0) opposed, with Councilmember Thomaides absent from the dais, to adopt Ordinance 2009-75, as previously captioned. The motion carried unanimously. 22. Consider an ordinance implementing the recommendation of the 2009 Sunset Advisory Commission report by retiring the Beautification Commission, Drainage Advisory Board, Minority Tourism Development Board, Transportation Advisory Board, and Youth Commission; repealing sections 2.111 - 2.112, 2.191 - 2.193, 2.362 - 2.363, 2.364 - 2.365, and 2.370.10 - 2.370.11, of Article 3, Chapter 2 of the San Marcos City Code pertaining to such boards and commissions; and providing an effective date; and consider ordinance on the first of two readings.
