Couch to approve the Consent Agenda, less items 13, 14 and 16. The motion carried <br />unanimously. <br />(13)MOTION: Upon a motion made by Councilmember Jones and a second by Councilmember <br />Couch, the City Council voted seven (7) for and none (0) opposed, to adopt Resolution 2009- <br />163R, as previously captioned. The motion carried unanimously. <br />(14) MOTION: Upon a motion made by Councilmember Porterfield and a second by <br />Councilmember Thomaides, the City Council voted six (6) for and none (0) opposed, with <br />Councilmember Jones abstaining, to adopt Resolution 2009-164$, as previously captioned. The <br />motion carried. <br />(16) MOTION: Upon a motion made by Councilmember Couch and a second by <br />Councilmember Porterfield, the City Council voted four (4) for and three (3) opposed, with <br />Councilmembers Thomaides, Bose and Porterfield voting against, to adopt Resolution 2009- <br />166R, as previously captioned. The motion carried. <br />Public Hearings <br />20. Public Hearing to receive comments for and against relief from the requirement to <br />construct public sidewalks on Veramendi, Quarry, and Prospect Streets at 1132 Belvin <br />Street in conjunction with platting or development of property. <br />Mayor Narvaiz opened the public hearing. Joe Schneider stated he feels these sidewalks should <br />0 t:1 <br />be built, or they should pay the City to have them built. There being no further comments, <br />Mayor Narvaiz closed the Public Hearing. <br />Non-Consent Agenda <br />21. Consider Ordinance 2009-75, on emergency, amending the City's 2009-2010 budget to <br />authorize the expenditure of funds from the liability insurance fund for professional <br />services; declaring an emergency and providing an effective date. <br />MOTION: Upon a motion made by Councilmember Jones and a second by Councilmember <br />Porterfield, the City Council voted six (6) for and none (0) opposed, with Councilmember <br />Thomaides absent from the dais, to adopt Ordinance 2009-75, as previously captioned. The <br />motion carried unanimously. <br />22. Consider an ordinance implementing the recommendation of the 2009 Sunset Advisory <br />Commission report by retiring the Beautification Commission, Drainage Advisory Board, <br />Minority Tourism Development Board, Transportation Advisory Board, and Youth <br />Commission; repealing sections 2.111 - 2.112, 2.191 - 2.193, 2.362 - 2.363, 2.364 - 2.365, <br />and 2.370.10 - 2.370.11, of Article 3, Chapter 2 of the San Marcos City Code pertaining to <br />such boards and commissions; and providing an effective date; and consider ordinance on <br />the first of two readings.
