• MOTION: Upon a motion made by Councilmember Thomaides and a second by <br />Councilmember Couch, the City Council voted seven (7) for and none (0) opposed, to approve <br />the ordinance on the first of two readings. The motion carried unanimously. <br />NON-CONSENT AGENDA <br />26. Consider adoption of Ordinance 2009-71, on emergency, amending Section 18.288 of <br />the San Marcos City Code to extend the six month moratorium on the issuance of licenses <br />for sexually oriented businesses for an additional two months; declaring an emergency; and <br />providing an effective date. <br />MOTION: Upon a motion made by Councilmember Couch and a second by Councilmember <br />Porterfield, the City Council voted seven (7) for and none (0) opposed, to adopt Ordinance 2009- <br />71 on emergency, as previously captioned. The motion carried unanimously. <br />27. Consider an ordinance amending Chapter 55, Municipal Court, Section 55.04. Powers <br />and Duties of Municipal Court Judge, by acknowledging the power of the Municipal Court <br />Judge to conduct wedding ceremonies and establishing a fee therefor; providing a savings <br />clause; providing for the repeal of any conflicting provisions, providing for publication; <br />and providing an effective date; and consider ordinance on first of two readings. <br />MOTION: Upon a motion made by Councilmember Porterfield and a second by <br />• Councilmember Couch, the City Council voted six (6) for and one (1) opposed, with <br />Councilmember Thomaides voting against, to approve the ordinance on the first of two readings. <br />The motion carried. <br />28. Consider an ordinance setting the rate for wholesale water treatment at the City's <br />surface water treatment plant at $0.4352 per thousand gallons; and including procedural <br />provisions; and consider ordinance on the first of two readings. <br />MOTION: Upon a motion made by Councilmember Couch and a second by Councilmember <br />Jones, the City Council voted seven (7) for and none (0) opposed, to approve the ordinance on <br />the first of two readings, with an amendment to revisit after one year to ascertain that the rate is <br />covering our costs. The motion carried unanimously. <br />29. Remove from table and consider adoption on second and final reading of Ordinance <br />2009-61, amending Chapter 2, Administration, Article 2, City Council, of the San Marcos <br />City Code to add a new Section 2.024, Council Compensation; including procedural <br />provisions; and establishing an effective date. <br />MOTION: Upon a motion made by Councilmember Jones and a second by Councilmember <br />Terry, the City Council voted five (5) for and two (2) opposed, with Councilmembers Porterfield <br />and Thomaides voting against, to adopt Ordinance 2009-61, as previously captioned, and <br />amended to provide for a review in the first quarter to finalize a quarterly review process.
