24. Public Hearing to receive comments for and against an amendment to the future land • <br />use map from "C" Commercial to "HDR" High Density Residential for an 8.188 acre, more <br />or less, tract of land located at 1311 North I-35; amending the official zoning may of the <br />city by rezoning this tract from "GC" General Commercial district to "MF-24" Multiple- <br />Family Residential district; and including procedural provisions; and consider adoption of <br />Zoning Ordinance 2009-70. <br />Mayor Narvaiz opened the Public Hearing at 8:11 p.m. <br />There being no further Public Comments, the Public Hearing was closed at 8:11 p.m. <br />MOTION: Upon a motion made by Councilmember Porterfield and a second by <br />Councilmember Couch, the City Council voted seven (7) for and none (0) opposed, to adopt <br />Ordinance 2009-70, as previously captioned, and amended to reflect an effective date of January <br />8, 2010. The motion carried unanimously. <br />25. Public Hearing to receive comments for and against an ordinance amending various <br />sections of the Land Development Code as follows: amending Chapter 1 by clarifying <br />procedures for approval of development applications, updating definitions, clarifying and <br />modifying procedures for establishment of historic districts and landmarks, clarifyine and <br />modifying procedures for issuance of a certificate of appropriateness related to activities in <br />historic districts or involving historic landmarks and clarifying procedures for approval of • <br />site preparation permits; amending Chapter 4 by designating setback requirements for lots <br />of one or more acres in SF-R districts; amending Chapter 5 by reconciling procedures for <br />establishment of historic districts with the procedures in Chapter 1, updating the list of <br />historic districts and landmarks in the city, modifying the criteria and procedures for <br />making a determination of demolition by neglect of historic structures and landmarks, <br />clarifying storm water runoff detention requirements, changing the requirements for <br />preservation of natural features and construction in flood hazard areas, eliminating <br />superfluous language regarding tree protection standards and modifying the requirements <br />for which areas of a property must be maintained in a natural state; amending Chapter 6 <br />by defining what is a fence, requiring permits for fences and adding restrictions for fencing <br />in public easements and certain residential and non-residential areas and adding parking <br />requirements for gyms; amending Chapter 7 by adding requirements for the extension of <br />wastewater lines, creating an option for payment of parkland dedication fee in an MU <br />district before issuance of a residential building permit; amending Chapter 8 by revising <br />definitions applicable to zoning; providing a savings clause; providing for the repeal of any <br />conflicting provisions; and providing an effective date, and consider ordinance on the first <br />of two readings. <br />Mayor Narvaiz opened the Public Hearing at 8:18 p.m. <br />There being no Public Comments, the Public Hearing was closed at 8:18 p.m. <br />• <br />RM111709 Minutes Page 6
