<br />47 <br /> <br />Regular Meeting <br /> <br />February 12, 1990 <br /> <br />Page 2 <br /> <br />Mayor Morris introduced for consideration approval of an <br />appointment to the Commission for Women. Mayor Morris moved to <br />appoint Patti Wenk to complete a vacancy and Ms. Kissler seconded <br />the motion, which passed unanimously. <br /> <br />Mayor Morris introduced a presentation by Mary Martinez, Director <br />of Planning, regarding activities of the census. Ms. Martinez <br />stated more promotion is needed regarding the census. Funding is <br />needed for printing material costs. Mr. Hernandez stated Staff <br />needs to have a bilingual person on duty at all times during the <br />census time. Mr. Gilley stated the City is making arrangements <br />to have information be included in utility billing regarding the <br />census. The Council requested an item be placed on the February <br />26 agenda for the Council's consideration regarding use of <br />contingency funds up to $2,000 for the printing costs. It was <br />consensus of Council to designate Rick Hernandez as the <br />designated Council Member Coordinator. Ms. Martinez stated she <br />is working with Patsy Greiner as Judge Rains' designee regarding <br />the County census coordination. <br /> <br />Mayor Morris introduced for consideration adoption of an <br />Ordinance on emergency, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, ORDERING A JOINT GENERAL AND SPECIAL ELECTION BY SAID <br />CITY AND THE SAN MARCOS CONSOLIDATED INDEPENDENT SCHOOL <br />DISTRICT TO BE HELD IN THE CITY OF SAN MARCOS, TEXAS ON MAY <br />5, 1990 FOR THE PURPOSE OF ELECTING A MAYOR, A CITY COUNCIL <br />MEMBER, PLACE THREE, AND A CITY COUNCIL MEMBER, PLACE FOUR, <br />AND FOR THE PURPOSE OF SUBMITTING TO THE VOTERS PROPOSED <br />AMENDMENTS TO THE CITY CHARTE~ AND SUBMITTING TO THE VOTERS <br />A PROPOSAL FOR RENEWAL OF A LEASE OF CITY PARK PROPERTY TO <br />THE SAN MARCOS LIONS CLUB; AND TO BE HELD WITHIN THE <br />BOUNDARIES OF SAID SCHOOL DISTRICT FOR THE PURPOSE OF <br />ELECTING A SCHOOL DISTRICT BOARD OF TRUSTEES MEMBER, PLACE <br />FIVE, A SCHOOL DISTRICT BOARD OF TRUSTEES MEMBER, PLACE SIX <br />AND A SCHOOL DISTRICT BOARD OF TRUSTEES MEMBER, PLACE SEVEN; <br />ESTABLISHING THE RATE OF COMPENSATION TO BE PAID JUDGES, <br />CLERKS AND ASSISTANTS TO THE TABULATION SUPERVISOR FOR <br />SERVICES RENDERED DURING SAID ELECTION; MAKING PROVISIONS <br />FOR THE CONDUCT OF THE ELECTION AND OTHER PROVISIONS <br />INCIDENT TO THE PURPOSES OF THIS ORDINANCE; AND DECLARING AN <br />EMERGENCY. <br /> <br />Mr. Moore moved for adoption of the Ordinance on emergency and <br />Mr. Plummer seconded the motion. Mr. Taylor provided the Council <br />with alternative wording for Section 12.02(a). Following <br />discussion, Mr. Guerra moved to amend the Ordinance on Page 3, <br />MEASURE NO. FIVE, Section 12.02 of the Charter to read as <br />follows (as read into the record by Mayor Morris): <br /> <br />"12.02(a) (2) A person is ineligible for election or <br />appointment to a position as an officer of the city if the <br />person has an ownership interest in a busienss entity that <br />has a contract or contracts for the sale to the city of any <br />land, materials, supplies or service in an amount of $7,500 <br />or more annually; provided that city council members shall <br />be subject to paragraph (3) below. Any city officer, other <br />than a city council member, who becomes ineligible under <br />this provision while in office shall forfeit the office <br />held. Any violation of these provisions shall render any <br />contract entered into between the city and the business <br />entity during the period of the violation voidable by the <br />city manager or the city council," <br /> <br />"12.02(a) (3) No member of the city council, and no employee <br />of the city shall have a financial interest in the sale to <br />the city of any land, materials, supply or service, outside <br />of the person's employment with the city, Any person having <br />
