Any violation of this provision with the actual or constructive knowledge of the city council member or employee shall render the contract voidable by the city manager or the city council." Mayor Morris introduced for consideration adoption of an Ordinance on emergency, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THAT ORDINANCE ADOPTED SEPTEMBER 11, 1989 WHICH SET FORTH AN ITEMIZED ESTIMATE OF THE EXPENSE OF CONDUCTING EACH ADMINISTRATIVE UNIT OF THE MUNICIPAL GOVERNMENT OF SAID CITY FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 1989 AND ENDING ON SEPTEMBER 30, 1990, AND APPROPRIATED MONEY FOR THE VARIOUS FUNDS AND PURPOSES OF SUCH ESTIMATE, TO REVISE SAID ESTIMATES AND TO REAPPROPRIATE SAID FUNDS, ADOPTING SAID REVISIONS AND ESTIMATES, AND DECLARING AN EMERGENCY. Ms. Kissler moved for approval of the Ordinance on first reading and Mr. Plummer seconded the motion. Mr. Guerra moved to amend the Ordinance in Sections 1 and 2 to change the hours to read: 8:00 p.m. to 8:00 a.m. and Ms. Kissler seconded the motion, which passed unanimously:--The Council voted unanimously for approval of the Ordinance on first reading. Mr. Moore moved for approval of the Ordinance on first reading and Mr. Hernandez seconded the motion, which passed unanimously. Mayor Morris introduced receiving a certified Referendum Petition regarding an Ordinance adopted by the City Council on January 22, 1990 designating Reinvestment Zone No.5. The petition had not yet been received, so Mayor Morris moved to table this matter and Mr. Moore seconded the motion, which passed unanimously.
