<br />48 <br /> <br />Regular Meeting <br /> <br />February 12, 1990 <br /> <br />Page 3 <br /> <br />such an interest shall be ineligible for election as a city <br />council member or appointment as an employee of the city, <br />and any city council member or employee who acquires such an <br />interest shall forfeit the office or employment. Any <br />violation of this provision with the actual or constructive <br />knowledge of the city council member or employee shall <br />render the contract voidable by the city manager or the city <br />council." <br /> <br />"12.02(a) (4) These provisions shall not apply to <br />acquisitions of property by the city under eminent domain <br />proceedings or the threat of eminent domain proceedings." <br /> <br />Ms. Kissler seconded Mr. Guerra's motion, which passed <br />unanimously (Mr. Moore not present to vote on this item). The <br />Council then voted unanimously for adoption of the Ordinance (Mr. <br />Moore not present to vote on this item). <br /> <br />Mayor Morris introduced for consideration adoption of an <br />Ordinance on emergency, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THAT ORDINANCE ADOPTED SEPTEMBER 11, 1989 <br />WHICH SET FORTH AN ITEMIZED ESTIMATE OF THE EXPENSE OF <br />CONDUCTING EACH ADMINISTRATIVE UNIT OF THE MUNICIPAL <br />GOVERNMENT OF SAID CITY FOR THE FISCAL YEAR BEGINNING <br />OCTOBER 1, 1989 AND ENDING ON SEPTEMBER 30, 1990, AND <br />APPROPRIATED MONEY FOR THE VARIOUS FUNDS AND PURPOSES OF <br />SUCH ESTIMATE, TO REVISE SAID ESTIMATES AND TO REAPPROPRIATE <br />SAID FUNDS, ADOPTING SAID REVISIONS AND ESTIMATES, AND <br />DECLARING AN EMERGENCY. <br /> <br />Ms. Kissler moved for adoption of the Ordinance on emergency and <br />Mr. Plummer seconded the motion, which passed unanimously (Mr. <br />Moore not present to vote on this item). <br /> <br />Mayor Morris introduced for consideration approval of an <br />Ordinance on first reading, the caption which was read as <br />follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING CHAPTER 29 OF THE SAN MARCOS CODE OF <br />ORDINANCES BY THE ADDITION OF A NO PARKING TOW-AWAY ZONE ON <br />DAILEY STREET AND DECLARING AN EFFECTIVE DATE. <br /> <br />Ms. Kissler moved for approval of the Ordinance on first reading <br />and Mr. Plummer seconded the motion. Mr. Guerra moved to amend <br />the Ordinance in Sections 1 and 2 to change the hours to read: <br />8:00 p.m. to 8:00 a.m. and Ms. Kissler seconded the motion, which <br />passed unanimously:--The Council voted unanimously for approval <br />of the Ordinance on first reading. <br /> <br />Mayor Morris introduced for consideration approval of an <br />Ordinance on first reading, the caption which was read as <br />follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING SECTION 29-144 OF THE SAN MARCOS CODE OF <br />ORDINANCES BY THE ADDITION OF A LOADING ZONE ON MARTIN <br />LUTHER KING DRIVE AND ESTABLISHING AN EFFECTIVE DATE. <br /> <br />Mr. Moore moved for approval of the Ordinance on first reading <br />and Mr. Hernandez seconded the motion, which passed unanimously. <br /> <br />Mayor Morris introduced receiving a certified Referendum Petition <br />regarding an Ordinance adopted by the City Council on January 22, <br />1990 designating Reinvestment Zone No.5. The petition had not <br />yet been received, so Mayor Morris moved to table this matter and <br />Mr. Moore seconded the motion, which passed unanimously. <br />
