<br />68 <br /> <br />Regular Meeting <br /> <br />February 26, 1990 <br /> <br />Page 3 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING SECTION 6 OF APPENDIX G - HISTORICAL ZONING <br />ORDINANCE OF THE SAN MARCOS CODE OF ORDINANCES TO ALLOW THE <br />HISTORIC PRESERVATION COMMISSION DISCRETION IN ESTABLISHING <br />MONTHLY MEETING DATES, AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Moore moved for approval of the Ordinance on first reading <br />and Mr. Hernandez seconded the motion, which passed unanimously. <br /> <br />Mayor Morris introduced receiving certification of a Referendum <br />Petition regardng an Ordinance adopted by the City Council on <br />January 22, 1990 pertaining to the creation of Reinvestment Zone <br />No.5. The Council received written certification, a copy which <br />is attached to these minutes. <br /> <br />Mayor Morris introduced for consideration reconsideration of an <br />Ordinance adopted by the City Council January 22, 1990. The <br />Council did not wish to reconsider the Ordinance pursuant to <br />Section 6.05(c) of the Charter). The caption of the Ordinance <br />reads as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, DESIGNATING A REINVESTMENT ZONE PURSUANT TO CHAPTER <br />312 OF THE TEXAS TAX CODE TO INCLUDE PROPERTY PARTIALLY <br />INSIDE AND PARTIALLY OUTSIDE OF THE CITY LIMITS OF SAID <br />CITY, COMPRISING AN AREA OF APPROXIMATELY 55.077 ACRES <br />LOCATED AT THE NORTHEAST CORNER OF THE INTERSECTION OF <br />INTERSTATE HIGHWAY 35 AND CENTERPOINT ROAD, TO BE KNOWN AS <br />REINVESTMENT ZONE NO.5; ESTABLISHING THE SPECIFIC <br />BOUNDARIES THEREOF; MAKING CERTAIN STATUTORY FINDINGS; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />Mayor Morris introduced for consideration adoption of an <br />Ordinance on emergency, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE ELECTION ORDINANCE ADOPTED FEBRUARY 12, <br />1990 BY ADDING A MEASURE AND PROPOSITION FOR THE PURPOSE OF <br />SUBMITTING TO THE VOTERS A REFERENDUM ON ADOPTION OF AN <br />ORDINANCE DESIGNATING REINVESTMENT ZONE NO. FIVE OF THE CITY <br />OF SAN MARCOS, TEXAS; DECLARING AN EMERGENCY AND DECLARING <br />AN EFFECTIVE DATE. <br /> <br />Mr. Hernandez moved for adoption of the Ordinance on emergnecy <br />and Mr. Guerra seconded the motion, which passed unanimously. <br /> <br />Mayor Morris introduced for consideration approval of minutes of <br />a Special Meeting held February 9, 1990 and Regular Meeting held <br />February 12, 1990, approval of two Ordinances on second reading, <br />adoption of four Resolutions, authorization to seek request for <br />proposals for Banking Services, aprpoval to authorize use of <br />contingency funds in an amount not to exceed $2,000.00 for the <br />reproduction costs of Census materials, approval of a contract <br />for services with McCulley, Frick & Gillman, Inc. for the <br />construction of additional monitoring wells and groundwater <br />testing and authorization for the City Manager to execute the <br />contract on behalf of the City, and approval to change the date <br />of the Regular Meeting scheduled Monday, March 12, 1990 to <br />Wednesday, March 7, 1990 at 7:30 p.m. by consensus. The Council <br />removed Items 11.C.(1), 11.C. (2) and 11.C.(3) from the consensus <br />agenda to be considered separately. Ms. Kissler moved to approve <br />the minutes of the Special Meeting held February 9, 1990 (Mr. <br />Guerra abstaining), the Regular Meeting held February 12, 1990, <br />approval of the two Ordinances on second reading, adoption of the <br />remaining Resolution, approval for authorization to seek request <br />for proposals for Banking Services, approval to authorize use of <br />contingency funds up to $2,000.00 for reproduction of Census <br />materials, approval of the contract for services with McCulley, <br />Frick & Gillman, Inc. and approval to change the date of the <br />
