<br />102 <br />Regular Meeting March 26, 1990 Page 2 <br />Mayor Morris introduced a presentation by the San Marcos River <br />Foundation, Et Al to support the City's adoption of a Litter <br />Abatement and Container Ordinance. Gwen Smith read a letter into <br />the record requesting a Litter Abatement and Container Ordinance <br />for the City. Mr~ Taylor advised there was no need for a City <br />Ordinance, as this could be handled through enforcement of <br />already existing state law. Mr. Gilley stated the Police <br />Reserves currently patrol the parks and along the river and that <br />the Police Department can be instructed to enforce the state law <br />to a greater degreee. Council directed Mr. Gilley to proceed <br />with more enforcement of the state law (The Council returned to <br />this item later in this meeting - Page 5). <br />Mayor Morris introduced for consideration adoption of an <br />Ordinance on emergency, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, RESCINDING AND REPEALING ORDINANCE 1989-70 PERTAINING <br /> TO TAXATION OF FREEPORT PROPERTY, FOR TAX YEARS 1991 AND <br /> THEREAFTER; DECLARING AN EMERGENCY; AND PROVIDING AN <br /> EFFECTIVE DATE. <br />Mr. Guerra moved for adoption of the Ordinance on emergency and <br />Ms. Kissler seconded the motion. Mr. Gilley stated this <br />exemption is on goods shipped into Texas .from out of state and <br />then..shipp.ed back out of state within 180 days. The Chamber of <br />Comm~rce provided the Council with information obtained through <br />the cooperation of the Economic Development Council and the San <br />Marcos Manufacturers AssociatiQn, indicating few companies who <br />could apply for the exemption would realize much savings due to <br />the clerical expense ínvolved for the required record keeping. <br />Mr. Gilley advised the Council TML's most recent information <br />regarding the -exemption shows 68% of the cities have not adopted <br />such an Ordinance and 32% of the cities have, including Austin <br />and Seguin. Mr. Gilley stated in the near future the City could <br />offer the Foreign Trade Zone as another way to subsidize <br />companies. On roll call the following vote was recorded: <br /> AYE: Guerra. <br /> NAY: Moore, Hernandez, Hart, Morris, Kissler, Plummer. <br />ABSTAIN: None. <br />Mayor Morris introduced for consideration approval of an <br />Ordinance on first reading, the caption which was read as <br />follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, AMENDING SECTIONS 10-38 AND 10-39 OF THE SAN MARCOS <br /> CODE OF ORDINANCES BY ADOPTING THE 1988 EDITION OF THE <br /> STANDARD FIRE PREVENTION CODE, THE 1989 REVISIONS THERETO; <br /> PROVIDING FOR SEVERABILITY; REPEALING ALL CONFLICTING <br /> ORDINANCES; PROVIDING A PENALTY AND DECLARING AN EFFECTIVE <br /> DATE. <br />Mr. Moore moved for approval of the Ordinance on first reading <br />and Mr. Hernandez seconded the motion, which passed unanimously. <br />Mayor Morris introduced for consideration approval of an <br />Ordinance on first reading, the caption which was read as <br />follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, AMENDING SECTION 2-6 OF THE SAN MARCOS CODE OF <br /> ORDINANCES TO PROHIBIT SMOKING IN THE SAN MARCOS MUNICIPAL <br /> AIRPORT TERMINAL BUILDING, REPEALING ALL CONFLICTING <br /> ORDINANCES; PROVIDING A PENALTY AND DECLARING AN EFFECTIVE <br /> DATE. <br />
