103 Regular Meeting March 26, 1990 Page 3 Mr. Moore moved for approval of the Ordinance on first reading and Ms. Kissler seconded the motion, which passed unanimously. Mayor Morris introduced for consideration approval of an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, PROHIBITING OUTDOOR COMMERCIAL AND CHARITABLE CAR WASHING ACTIVITIES; PROVIDING FOR SEVERABILITY; REPEALING ALL CONFLICTING ORDINANCES; PROVIDING A PENALTY; PROVIDING FOR PUBLICATION AND PROVIDING AN EFFECTIVE DATE. Ms. Kissler moved for approval of the Ordinance on first reading and Mr. Guerra seconded the motion. The revision to the Water Conservation Plan will come to the Council in May. This Ordinance can be included in the Conservation Plan. Regarding citing for violation of the Ordinance, either an individual or an organization can be cited. Ms. Millecam was requested to publicize the need to conserve water. Those groups wishing to hold carwashes as fundraisers are encouraged to work with commercial carwashes to sponsor the events. Martha Latta, who served as Chairperson of the Council's Water Conservation Committee (Temporary) / stated she was in favor of carwashes being held at commercial carwash facilities. The City Attorney will provide language to the Council at second reading for the addition of carwashes being held at commercial carwash establishments. The Council voted unanimously for approval of the Ordinance on first reading. Mayor Morris introduced for consideration approval of minutes of the Regular Meeting held March 7, 1990/ approval of an Ordinance on second reading, adoption of an Ordinance on third and final reading, adoption of five Resolutions, approval for payment of the 1990 Membership Dues to the Greater Austin-San Antonio Corridor Council in the amount of $1,500.00, approval for the use of $10,000.00 from General Fund Contingency Funds for the City's portion of a match regarding the Grant Application submitted to the Texas Historical Commission for restoration of the Calaboose by consensus. The Council removed Items 8.D.(2), 8.D.(3) and 8.F. to consider separately. Mr. Guerra moved to approve the minutes of the Regular Meeting held March 7, 1990, approve the Ordinance on second reading, adopt the Ordinance on third and final reading, adopt the three Resolutions not removed from the consensus agenda, and approve the payment of membership dues to the Corridor Council by consensus and Ms. Kissler seconded the motion, which passed unanimously. The captions of the Ordinances and Resolutions read as follows: Approval of Ordinance on second reading: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING CHAPTER 12, SECTION 12-8, GARBAGE AND RUBBISH COLLECTION CHARGES BY CITY FOR RESIDENTIAL UNITS, OF THE SAN MARCOS CODE OF ORDINANCES TO DECREASE THE MONTHLY AMOUNT DEPOSITED IN THE ESCROW OR RESERVE FUND AND DECLARING AN EFFECTIVE DATE. Adoption of Ordinance on third and final reading: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTION 6 OF APPENDIX G - HISTORICAL ZONING ORDINANCE OF THE SAN MARCOS CODE OF ORDINANCES TO ALLOW THE HISTORIC PRESERVATION COMMISSION DISCRETION IN ESTABLISHING MONTHLY MEETING DATES, AND DECLARING AN EFFECTIVE DATE.
