• ORDINANCE NO. 2009-73 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE OF THE CITY OF SAN <br />MARCOS, TEXAS AMENDING VARIOUS SECTIONS OF THE LAND <br />DEVELOPMENT CODE AS FOLLOWS: AMENDING CHAPTER 1 BY <br />CLARIFYING PROCEDURES FOR APPROVAL OF DEVELOPMENT <br />APPLICATIONS, UPDATING DEFINITIONS, CLARIFYING AND <br />MODIFYING PROCEDURES FOR ESTABLISHMENT OF HISTORIC <br />DISTRICTS AND LANDMARKS, CLARIFYING AND MODIFYING <br />PROCEDURES FOR ISSUANCE OF A CERTIFICATE OF <br />APPROPRIATENESS RELATED TO ACTIVITIES IN HISTORIC DISTRICTS <br />OR INVOLVING HISTORIC LANDMARKS AND CLARIFYING <br />PROCEDURES FOR APPROVAL OF SITE PREPARATION PERMITS; <br />AMENDING CHAPTER 4 BY DESIGNATING SETBACK REQUIREMENTS <br />FOR LOTS OF ONE OR MORE ACRES IN SF-R DISTRICTS; AMENDING <br />CHAPTER 5 BY RECONCILING PROCEDURES FOR ESTABLISHMENT OF <br />HISTORIC DISTRICTS WITH THE PROCEDURES IN CHAPTER 1, <br />UPDATING THE LIST OF HISTORIC DISTRICTS AND LANDMARKS IN <br />THE CITY, MODIFYING THE CRITERIA AND PROCEDURES FOR <br />MAKING A DETERMINATION OF DEMOLITION BY NEGLECT OF <br />HISTORIC STRUCTURES AND LANDMARKS, CLARIFYING STORM <br />WATER RUNOFF DETENTION REQUIREMENTS, CHANGING THE <br />REQUIREMENTS FOR PRESERVATION OF NATURAL FEATURES AND <br />• CONSTRUCTION IN FLOOD HAZARD AREAS, ELIMINATING <br />SUPERFLUOUS LANGUAGE REGARDING TREE PROTECTION <br />STANDARDS AND MODIFYING THE REQUIREMENTS FOR WHICH <br />AREAS OF A PROPERTY MUST BE MAINTAINED IN A NATURAL <br />STATE; AMENDING CHAPTER 6 BY DEFINING WHAT IS A FENCE, <br />REQUIRING PERMITS FOR FENCES AND ADDING RESTRICTIONS FOR <br />FENCING IN PUBLIC EASEMENTS AND CERTAIN RESIDENTIAL AND <br />NON-RESIDENTIAL AREAS AND ADDING PARKING REQUIREMENTS <br />FOR GYMS; AMENDING CHAPTER 7 BY ADDING REQUIREMENTS FOR <br />THE EXTENSION OF WASTEWATER LINES, CREATING AN OPTION <br />FOR PAYMENT OF PARKLAND DEDICATION FEE IN AN MU DISTRICT <br />BEFORE ISSUANCE OF A RESIDENTIAL BUILDING PERMIT; <br />AMENDING CHAPTER 8 BY REVISING DEFINITIONS APPLICABLE TO <br />ZONING. PROVIDING A SAVINGS CLAUSE; PROVIDING FOR THE <br />REPEAL OF ANY CONFLICTING PROVISIONS; AND PROVIDING AN <br />EFFECTIVE DATE <br />RECITALS: <br />I . Various revisions to the Land Development Code are necessary to reflect changes <br />in the City's organizational structure, to reorganize certain sections in a more logical order, to <br />• correct grammatical and typographical errors and to enable the City to better address conditions
