and the building setback line when adjacent to a public or private street <br />right-of-way, park or trail. <br />(3) Height o fences. Any fence or wall located between the street ri hg t-of- <br />way and the front facade (or side facade if a corner lot) of a building shall <br />not exceed three feet in height unless one of the following conditions <br />applies: <br />a. The fence is less than eight feet tall and is on property in an <br />Industrial or Heavy Commercial zoning district. <br />b. The fence is less than eight feet tall, decorative and encloses only <br />outdoor dining or recreation areas. <br />(4) Fences between buildings on the same lot. Any fence located facing a <br />street that is between adjacent buildings and behind the front most facade <br />of either building may not exceed eight feet in height. <br />(b) Fences Permitted Along Private Propertv Lines. <br />(1) Materials permitted. Generally fences or walls may be constructed of <br />wood. decorative metal, masonrv, chain link or other similar materials. <br />New and innovative materials may be approved for use by the responsible <br />official if the material is compatible. <br />(2) Location of fencing. Fences are permitted along adjacent property lines <br />situated as follows: <br />a. No fencing shall be placed along an adjacent property line with <br />segments that are not in conformance with subsection (b) of this <br />section. <br />b. No fencing shall be located in a manner to preclude landscape <br />maintenance or fence repair without a suitable access agreement. <br />C. No fencing above three feet in height shall be located closer than <br />the building setback line adjacent to single family residential uses. <br />d. No chainlink or wire fencing shall be located closer than the <br />building setback line adjacent to single family or multiple-family <br />residential uses. <br />(3) Height of fences. All fences or walls located along adjacent lines <br />shall be no taller than eight feet at the building setback line or six feet if <br />• located closer unless the following conditions are met:
