• <br />Section 1.5.6.5 Criteria for Approval <br />(a) The following criteria shall be used to determine whether the application for a Certificate <br />of Appropriateness shall be approved, conditionally approved or denied: <br />(1) Consideration of the effect of the activity on historical, architectural or cultural <br />character of the historic district or landmark; <br />(2) For historic zoning districts, compliance with zoning district regulations; <br />(3) Whether the property owner would suffer extreme hardship, not including loss of <br />profit, unless the Certificate of Appropriateness is issued. <br />(4) The construction and repair standards and guidelines cited in Section 4.2.5.1(1). <br />Section 1.8.1.1 Purpose, Applicability, Exceptions and Effect <br />(a) Purpose. The purpose of a Site Preparation Permit shall be to apply the zoning, <br />environmental, development and public facilities standards contained in Chapters 4, 5, 6 <br />and 7 of this Land Development Code to a specific development design proposed for a <br />platted tract, parcel or lot. A Site Preparation Permit assures that preparatory <br />construction activities on the development site will meet City standards prior to soil <br />• disturbance, construction or placement of a structure on the tract, parcel or lot. A Site <br />Preparation Permit application may consist of a series of schematic drawings designed <br />to satisfy one or more criteria governing the decision on the permit. <br />(b) Applicability. Approval of a Site Preparation Permit is required prior to any non-exempt <br />development of land within the City limits or within the City's extraterritorial jurisdiction. <br />Within the City limits, the zoning, environmental, development and public facilities <br />standards in Chapters 4, 5, 6 and 7 of this Land Development Code apply to a Site <br />Preparation Permit application. Within the City's extraterritorial jurisdiction, only the <br />environmental and public facilities standards in Chapters 5 and 7 and any development <br />standards required by plat note apply to a Site Preparation Permit application. <br />(c) Exceptions. The requirements of a Site Preparation Permit do not apply in whole or in <br />part to the following activities or land uses: <br />(1) Categorical exemptions. <br />a. Clearing that is necessary only for surveying purposes. <br />b. Construction or placement of a single-family dwelling, duplex dwelling or <br />industrialized home on a legally platted lot, except for: <br />1. Landscaping, open space and tree preservation standards; <br />2. Public facilities standards related to subsurface sewage disposal; <br />or <br />3. Floodplain improvement standards. <br />C. Lot improvements authorized under approved construction plans for a <br />platted subdivision or tract.
