(2) Partial exemptions - zoning regulations. The following proposed land uses or <br /> <br />activities are exempt from Site Preparation Permit requirements related to • <br />compliance with Chapter 4, Zoning Regulations: <br />a. Agricultural uses; <br />b. Single-family and duplex, or two-family, residential uses (multifamily, <br />single-family attached, manufactured/mobile home, and nonresidential <br />development projects in single- or two-family residential districts, such as <br />churches, schools and day care facilities, are not exempt); <br />C. Public utilities authorized to use City rights-of-way and public utility <br />easements by separate agreement or by state law; and <br />d. Existing nonresidential and multifamily uses that do not expand more than <br />ten percent of the building's originally constructed floor area, and for <br />which any additional required parking is provided. <br />(3) Partial exemptions - environmental regulations. The following proposed land <br />uses or activities are exempt from Site Preparation Permit requirements related <br />to compliance with the standards in Chapter 5, Environmental Regulations: <br />a. Any land subject to an approved development plat; <br />b. Any structure that is to be replaced or enlarged up to a maximum amount <br />equal to 50% of the structure's original floor area; and <br />c. Agricultural uses. <br />(4) Partial exemptions - development standards. The following proposed land uses <br />• <br />or activities are exempt from Site Preparation Permit requirements related to <br />compliance with the development standards in Chapter 6: <br />a. Existing nonresidential and multifamily uses that do not expand more than <br />10% of the building's originally constructed floor area, and for which any <br />additional required parking is provided; and <br />b. Agricultural uses. <br />(5) Partial exemptions - public facilities standards. The following proposed land uses <br />or activities are exempt from Site Preparation Permit requirements related to <br />compliance with the public facilities standards in Chapter 7: <br />a. Any land subject to an approved development plat; and <br />b. Existing platted lots where no site improvements are proposed. <br />(d) Effect. Approval of a Site Preparation Permit authorizes site preparatory activities other <br />than construction or placement of a structure on the land, subject to the terms of the <br />permit and for the duration of the permit. Approval of a Site Preparation Permit also <br />authorizes the property owner to apply for a construction permit. <br />Section 1.9.6.3 Inspection <br />(a) Required.
