10. "Party" or "Parties" means the City of San Marcos and the San Marcos Professional <br />Firefighters Association Local # 3963. <br />11 "Firefighter" means a person who is defined as fire protection personnel under Section <br />419.021, Texas Government Code and who is employed in the City of San Marcos Fire <br />Department and does not include non Fire Department employees. <br />12. "TDHS" means the Texas Department of Human Services or is successor. <br />13. "TLGC" means the Texas Local Government Code. <br />14. "Member" means a Firefighter. <br />ARTICLE 3 <br />HIRING <br />Section 1. Eligibility List. <br />(a) This article shall supersede Section 143.025 of the Texas Local Government Code to allow <br />for more than one eligibility list to be in effect at the same time which shall be utilized upon the <br />exhaustion or expiration of the prior list. <br />(b) Additional points may be awarded only to an applicant for a beginning position with a <br />passing score as follows: <br />Honorable Discharge from United States Armed Forces 5 points <br />OR <br />60 or more College Hours <br />5 points <br />OR <br />Current TDHS Paramedic Certification (EMT-P) 5 points <br />*No cumulative points for college hours, military service or paramedic certification are allowed <br />such that the maximum total points for any applicant is 5 points. <br />Section 2. Preemption. <br />To the extent of any conflict, the provisions of this article preempt TLGC Chapter 143 including <br />Section 143.025(f), and any state statute, local ordinance, executive order, civil service provision <br />or rule adopted by the head of the Fire department or City of San Marcos or by a division or <br />agent of the City such as a personnel board or civil service commission as per TLGC Section <br />142.117. <br />5
