ARTICLE 4 <br />WAGES AND COMPENSATION <br />Section 1. Base Pay. <br />The base rate for Firefighters shall be determined as follows (Attachment A): <br />(A) For the First Contract Year: No increase. <br />(B) For the Second Contract Year: 2.25% <br />(C) For the Third Contract Year: 2.25% <br />Section 2. Longevity Pay. <br />Effective October 1, 2009, Longevity Pay will be paid as set forth in the table attached to this <br />Agreement and marked Attachment B. Longevity pay is capped after 20 years of service. <br />Section 3. Implementation. <br />It is expressly understood and agreed that the implementation and payment of the additional <br />compensation and pays provided herein may be delayed due to the City upgrading its payroll <br />program and procedures. However, any delayed payment will be made on or before the sixtieth <br />day after the date of approval of this Agreement by the City Council and ratified by the <br />Association, whichever is later. <br />Section 4. Preemption. <br />To the extent of any conflict, the provisions of this Article preempt TLGC Chapter 141, 142 and <br />143, including Section 141.032, 141.033, and 143.038, and 143.041, and any state statute, local <br />ordinance, executive order, civil service provision or rule adopted by the head of the Fire <br />department or City of San Marcos or by a division or agent of the City such as a personnel board <br />or civil service commission as per TLGC Section 142.117. <br />ARTICLE 5 <br />RESIDENCY INCENTIVE <br />Effective on the date of this Agreement and subject to the appropriation of funding for the <br />program during each fiscal year, a Firefighter (excluding spouses who are also a firefighter) who <br />moves into and agrees to maintain his principal residence and actually resides within the city <br />limits of the City may be eligible for residency incentive. The terms, conditions, eligibility, and <br />amount of such program shall be determined by the City. The parties agree that this Article <br />supersedes any conflicting provisions of Section 150.021 (for this program only) and Section <br />143.041(b) and any other applicable provision of the Texas Local Government Code. <br />6
