ARTICLE 6 <br />SICK LEAVE AND VACATIONS <br />Section 1. Sick Leave. <br />Notwithstanding TLGC 143.045, Firefighters will accrue and use sick leave on the basis of <br />hours. A Firefighter who leaves the classified service for any reason is entitled to payment for <br />his/her accumulated sick leave as per current practice as of October 1, 2009, at the firefighters <br />base pay hourly rate at their current classification and pay step. This provision shall, to the extent <br />of any conflict, supersede TLGC §143.045, any state statute, city ordinance, city policy, <br />Department rule or local civil service rule. <br />Section 2. Vacation. <br />Notwithstanding TLGC § 143.046, Firefighters will accrue and use vacation leave on the basis of <br />hours. A Firefighter who leaves the classified service for any reason is entitled to payment for <br />his/her accumulated vacation leave as per current practice as of October 1, 2009 at the <br />firefighters base pay hourly rate at their current classification and pay step. This provision shall, <br />to the extent of any conflict, supersede TLGC §143.046, any state statute, city ordinance, city <br />policy, Department rule or local civil service rule. <br />ARTICLE 7 <br />REORGANIZATION AND RECLASSIFICATIONS <br />Section 1. Reorganization. <br />The Parties agree and understand that the reorganization and reclassification of Fire personnel to <br />improve efficiency is in the mutual interest of the Parties. It is intended that the reorganization <br />be implemented in the least disruptive and most efficient manner. To that end, the Parties agree <br />to the following modifications effective thirty (30) days after execution of this Agreement, <br />except as provided herein: <br />A. Reclassification of Division Chief (1) to Assistant Chief (1) <br />The position of Division Chief will be reclassified to a second Assistant Fire Chief position. The <br />incumbent Division Chief will be appointed by the Fire Chief to the second Assistant Chief <br />position which will be an appointed position subject to the provisions of and as provided in <br />Texas Local Government Code Section 143.014 except that the number of appointed Assistant <br />Chief positions is increased from one to two positions. The classification and position of <br />Division Chief will be eliminated. If the appointed Assistant Chief is removed (without any <br />charges being filed), he shall be reinstated in the Department and placed in the same <br />classification or its equivalent that the person held before appointment. If the position of <br />Division Chief does not exist at that time, the person will be placed in a Battalion Chief position. <br />If the position of Lieutenant does not exist at that time, the person will be placed in a Captain <br />position. Any person bumped as a result of the removal of an Assistant Chief will be placed on a <br />7
