64 Regular Meeting June 11, 1990 Page 2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE CITY BUDGET ORDINANCE FOR THE 1989-1990 FISCAL YEAR (ORDINANCE 1989-38) TO PROVIDE FUNDING FOR OVERTIME PAY FOR WIC PROGRAM EMPLOYEES; AND DECLARING AN EMERGENCY. Mr. Moore moved for adoption of the Ordinance and Mr. Plummer seconded the motion, which passed unanimously. Mayor Morris introduced for consideration approval of an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTIONS 29-111 AND 29-150 OF THE SAN MARCOS CODE OF ORDINANCES BY ADDING A NO PARKING TOW-AWAY ON COMANCHE STREET; PROVIDING FOR SEVERABILITY; REPEALING ALL CONFLICTING ORDINANCES; PROVIDING A PENALTY; PROVIDING FOR PUBLICATION AND DECLARING AN EFFECTIVE DATE. Mr. Hart moved for approval of the Ordinance on first reading and Mr. Moore seconded the motion, which passed unanimously. Mayor Morris introduced for consideration adoption of an Ordinance on third and final reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING AND ADOPTING A CAPITAL IMPROVEMENTS PLAN AS A BASIS FOR THE IMPOSITION OF IMPACT FEES; AMENDING PORTIONS OF CHAPTER 30 OF THE SAN MARCOS CODE OF ORDINANCES PERTAINING TO THE CALCULATION, ASSESSMENT AND COLLECTION OF WATER AND SEWAGE SYSTEM CAPITAL RECOVERY FEES TO MAKE REFERENCE TO WATER AND SEWAGE SYSTEM IMPACT FEES; AMENDING THE AMOUNTS OF THESE FEES; PROVIDING FOR CALCULATION OF THESE FEES BASED UPON SERVICE UNITS RATHER THAN LIVING UNIT EQUIVALENTS; PROVIDING FOR SEVERABILITY; REPEALING ALL CONFLICTING ORDINANCES; PROVIDING A PENALTY; PROVIDING FOR PUBLICATION AND PROVIDING AN EFFECTIVE DATE. Mr. Moore moved for adoption of the Ordinance on third and final reading and Mr. Hart seconded the motion. Mr. Hart moved to amend the Ordinance to provide for collection of impact fees for structures and uses located outside the city limits but connected to the city water or sewage system as contained in Mr. Taylor's memorandum to the Council dated June 6, 1990 and Mr. Moore seconded the motion. Mayor Morris read the changes into the record as follows: Section 30-43: Add the sentence "In the case of construction activity involving structures or uses located outside the city limits but connected to the city sewage system, the impact fee shall be paid in full prior to the issuance of the plumbing permits" as the next to last sentence; Section 30-46, Subsection (a): Add to the first sentence after the word "city" the phrase "or connected to the city wastewater system" and continue with the remainder of the sentence; Section 30-63: Add the sentence "In the case of construction activity involving structures or uses located outside the city limits but connected to the city water system, the impact fee shall be paid in full prior to the issuance of the plumbing permit" as the next to last sentence; Section 30-66, Subsection (a): Add to the first sentence after the word "city" the phrase "or connected to the city water system" and continue with the remainder of the sentence. The Council voted unanimously for approval of the amendments. The Council then voted unanimously for adoption of the Ordinance on third and final reading. Mayor Morris introduced for consideration reconsideration of a Zoning Ordinance. The Council did not wish to reconsider this Ordinance. The caption reads as follows:
