<br />64 <br /> <br /> <br /> <br /> <br />Regular Meeting June 11, 1990 Page 2 <br /> <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE CITY BUDGET ORDINANCE FOR THE 1989-1990 <br />FISCAL YEAR (ORDINANCE 1989-38) TO PROVIDE FUNDING FOR <br />OVERTIME PAY FOR WIC PROGRAM EMPLOYEES; AND DECLARING AN <br />EMERGENCY. <br /> <br />Mr. Moore moved for adoption of the Ordinance and Mr. Plummer <br />seconded the motion, which passed unanimously. <br /> <br />Mayor Morris introduced for consideration approval of an <br />Ordinance on first reading, the caption which was read as <br />follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING SECTIONS 29-111 AND 29-150 OF THE SAN MARCOS <br />CODE OF ORDINANCES BY ADDING A NO PARKING TOW-AWAY ON <br />COMANCHE STREET; PROVIDING FOR SEVERABILITY; REPEALING ALL <br />CONFLICTING ORDINANCES; PROVIDING A PENALTY; PROVIDING FOR <br />PUBLICATION AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Hart moved for approval of the Ordinance on first reading and <br />Mr. Moore seconded the motion, which passed unanimously. <br /> <br />Mayor Morris introduced for consideration adoption of an <br />Ordinance on third and final reading, the caption which was read <br />as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING AND ADOPTING A CAPITAL IMPROVEMENTS PLAN AS <br />A BASIS FOR THE IMPOSITION OF IMPACT FEES; AMENDING PORTIONS <br />OF CHAPTER 30 OF THE SAN MARCOS CODE OF ORDINANCES <br />PERTAINING TO THE CALCULATION, ASSESSMENT AND COLLECTION OF <br />WATER AND SEWAGE SYSTEM CAPITAL RECOVERY FEES TO MAKE <br />REFERENCE TO WATER AND SEWAGE SYSTEM IMPACT FEES; AMENDING <br />THE AMOUNTS OF THESE FEES; PROVIDING FOR CALCULATION OF <br />THESE FEES BASED UPON SERVICE UNITS RATHER THAN LIVING UNIT <br />EQUIVALENTS; PROVIDING FOR SEVERABILITY; REPEALING ALL <br />CONFLICTING ORDINANCES; PROVIDING A PENALTY; PROVIDING FOR <br />PUBLICATION AND PROVIDING AN EFFECTIVE DATE. <br /> <br />Mr. Moore moved for adoption of the Ordinance on third and final <br />reading and Mr. Hart seconded the motion. Mr. Hart moved to <br />amend the Ordinance to provide for collection of impact fees for <br />structures and uses located outside the city limits but connected <br />to the city water or sewage system as contained in Mr. Taylor's <br />memorandum to the Council dated June 6, 1990 and Mr. Moore <br />seconded the motion. Mayor Morris read the changes into the <br />record as follows: Section 30-43: Add the sentence "In the case <br />of construction activity involving structures or uses located <br />outside the city limits but connected to the city sewage system, <br />the impact fee shall be paid in full prior to the issuance of the <br />plumbing permits" as the next to last sentence; Section 30-46, <br />Subsection (a): Add to the first sentence after the word "city" <br />the phrase "or connected to the city wastewater system" and <br />continue with the remainder of the sentence; Section 30-63: Add <br />the sentence "In the case of construction activity involving <br />structures or uses located outside the city limits but connected <br />to the city water system, the impact fee shall be paid in full <br />prior to the issuance of the plumbing permit" as the next to last <br />sentence; Section 30-66, Subsection (a): Add to the first <br />sentence after the word "city" the phrase "or connected to the <br />city water system" and continue with the remainder of the <br />sentence. The Council voted unanimously for approval of the <br />amendments. The Council then voted unanimously for adoption of <br />the Ordinance on third and final reading. <br /> <br />Mayor Morris introduced for consideration reconsideration of a <br />Zoning Ordinance. The Council did not wish to reconsider this <br />Ordinance. The caption reads as follows: <br />
