Mr. Guerra moved to amend his motion to <br />amend Section 3 of the ordinance by and substituting it with the <br />regular language and to require space for City Council signatures <br />for recordation purposes and to return it to the Council for their <br />next meeting. Mr. Plummer seconded the amended motion which <br />passed unanimously. The Council then voted to approve the <br />original motion. The motion passed unanimously. <br /> <br />Mayor Pro Tern Moore introduced for consideration on first <br />reading the approval of an Ordinance, the caption was read as <br />follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING CITY WATER CONSERVATION REGULATIONS PERTAINING <br />TO THE TIME PERIOD FOR USE OF AUTOMATIC SPRINKLER SYSTEMS; <br />PROVIDING FOR SEVERABILITY; REPEALING ALL CONFLICTING <br />ORDINANCES; PROVIDING A PENALTY; PROVIDING FOR PUBLICATION; <br />DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE. <br /> <br />Mr. Guerra moved for approval of the Ordinance on first reading and Mr. <br />Plummer seconded the motion. Mr. Moore stated that the nature of the <br />ordinance proposed is to make some amendments suggested by citizen <br />input and the input of technical persons. Mr. Moore stated that the <br />City has asked that automatic water systems be run only during a <br />specific time of day. Mr. Moore stated that it was his understanding <br />that Police Chief Martin's department would start enforcement of <br />the Ordinance on June 26 at 5:00 p.m. Chief Martin stated that it was <br />their intent to issue warning citations for the first violations and to <br />issue citations to repeat offenders. Mr. George VonderLippe supported <br />the Council's water conservation efforts but did not agree with the <br />amendment. He stated it was inequitable because it would allow for <br />automatic sprinklers to run for six hours per day. Ms. Hughson stated <br />the the Council needed to explain to the public what a positive <br />shut-off nozzle was. Ms. Hughson suggested that the press explain <br />this in some way that the public could understand. Mr. Taylor stated <br />that the point the Chief of Police had made regarding fairness was that <br />lawn watering could be made by any means within a specific amount <br />time and the other would be to eliminate the special treatment that <br />automatic sprinklers get and require everyone to the hand held <br />requirements. Mr. Guerra moved that Section 1 of the Ordinance be <br />amended to delete (l)(B). Mr. Hernandez seconded the motion. Several <br />other suggestions were made by Mr. Plummer and Chief Tom Martin. <br />Discussion ensued. Mr. Guerra withdrew his earlier motion and Mr. <br />Hernandez withdrew his second. Mr. Plummer moved that the ordinance <br />be amended to delete the requirement of the hand held hose with the <br />positive shut-off nozzle in section (l)(A). Mr. Hernandez seconded the <br />motion. Mr. Plummer stated that it should be advertised that the <br />City prefer that people water only once a week. The Council voted on <br />the amendment made by Mr. Plummer which passed unanimously. On the <br />main motion the motion passed unanimously. <br /> <br />The City Council recessed at 9:40 p.m. and reconvened at 9:50 <br />p.m. <br /> <br />Mayor Pro Tern Moore introduced for consideration on first <br />reading the approval of an Ordinance, the caption was read as <br />follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING CHAPTER 12, SECTION 12-8, GARBAGE AND RUBBISH <br />COLLECTION CHARGES BY CITY FOR RESIDENTIAL UNITS, OF THE SAN <br />MARCOS CODE OF ORDINANCES TO DECREASE THE MONTHLY AMOUNT <br />DEPOSITED IN THE ESCROW OR RESERVE FUND AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />Mr. Hart moved for approval of the Ordinance and Mr. Plummer seconded <br />the motion which passed unanimously. Mr. Moore stated that it was his <br />understanding that the twenty-two cents is in addition to the <br />recent increase that was taken from the landfill reserve and it <br />retains the rate at a steady rate. <br />
