KNOWLES, JR., VOLUME 160, PAGE 34, DEED RECORDS, <br /> HAYS COUr:;¡TT, TEXAS, LOCATED AT 1331-1425 RANCH ROAD 12, FROM <br /> "R-1" (SINGLE-FAMILY DWELLING DISTRICT [LOW DENSITY]) TO "C" <br /> (COMMERCIAL DISTRICT), AND DECLARING AN EFFECTIVE DATE. <br />Mayor Morris opened the public hearing and asked if anyone wished <br />to speak for or against the zoning amendment. Q. A. Watson, one <br />of the owners of the property, asked when this matter could come <br />back to the Council for consideration with a new zoning <br />designation. The Council directed Staff handle the legal <br />questions pertaining to public notices and whether or not the <br />property owners within 200 feet of the property needed to be <br />notified. No one else wished to speak, so Mayor Morris closed <br />the public hearing. Ms. Kissler moved to table this matter and <br />Mr. Plummer seconded the motion, which passed unanimously. <br />Mayor Morris introduced for consideration approval of an <br />Ordinance on second reading, the caption which was read as <br />follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, ESTABLISHING A FRANCHISE AGREEMENT BETWEEN THE CITY <br /> AND THE PEDERNALES ELECTRIC COOPERATIVE, INC.. FOR THE <br /> PROVISION OF ELECTRICAL SERVICE WITHIN A PORTION OF THE CITY <br /> FOR A PERIOD OF TEN YEARS, AND THAT THE CITY OF SAN MARCOS <br /> SHALL RECEIVE A QUARTERLY FRANCHISE FEE FOR SUCH USE, <br /> PROVIDING FOR INDEMNIFICATION OF THE CITY OF SAN MARCOS, AND <br /> DECLARING AN EFFECTIVE DATE. <br />Mr. Moore moved for approval of the Ordinance on second reading <br />and Mr. Hart seconded the motion. Mayor Morris moved to amend <br />the Ordinance caption to read ". . . PERIOD OF TEN YEARS . . . , II <br />and Mr. Guerra seconded the motion, which passed unanimously. <br />The Council then voted unanimously for approval of the Ordinance <br />on second reading. <br />Mayor Morris introduced for consideration adoption of a <br />Resolution, the caption which was read as follows: <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY. OF SAN MARCOS, <br /> TEXAS, AUTHORIZING THE SUBMISSION OF A TEXAS COMMUNITY <br /> DEVELOPMENT PROGRAM APPLICATION TO THE TEXAS DEPARTMENT OF <br /> COMMERCE FOR THE HOUSING DEVELOPMENT FUND"; AUTHORIZING THE <br /> CITY MANAGER TO ACT AS THE CITY'S AUTHORIZED REPRESENTATIVE <br /> IN ALL MATTERS PERTAINING TO THE CITY'S PARTICIPATION IN THE <br /> COMMUNITY DEVELOPMENT PROGRAM; AND DECLARING AN EFFECTIVE <br /> DATE. <br />Mr. Moore moved for adoption of the Resolution and Ms. Kissler <br />seconded the motion. Ms. Clotille Haynes advised the Council she <br />thinks this is a good application with the commitment of land by <br />the City. The Council voted unanimously for adoption of the <br />Resolution. <br />Mayor Morris introduced for consideration approval of minutes of <br />the Regular Meeting held June 25, 1990 and Special Meeting held <br />July 2, 1990; approval of four Ordinances on second reading; <br />adoption of an Ordinance on third and final reading; adoption of <br />seven Resolutions; authorization to bid for a compact pickup for <br />
