R. G. Phillips stated he is not <br />opposed to the annexation, as the voters have consented to the <br />reinvestment zone. Mr. Phillips asked the City Attorney if the City <br />had authority to establish a reinvestment zone outside its city <br />limits, and Mr. Taylor stated the City has authority within its ETJ. <br />Mr. Phillips stated the City has been remiss in not annexing the <br />property sooner in order to collect sales tax revenues. No one else <br />wished to speak, so Mayor Morris closed the public hearing. <br /> <br />Mayor Morris introduced for consideration a public hearing and <br />adoption of a Resolution, the caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE FUTURE LAND USE MAP OF THE MASTER PLAN OF <br />THE CITY FROM LOW DENSITY RESIDENTIAL TO COMMERCIAL, FOR LOTS <br />4-8 OUT OF THE PERKINS ADDITION, TOGETHER WITH THREE UNPLATTED <br />TRACTS OF LAND, AS FOLLOWS: TRACT 1: 0.580 ACRES OUT OF THE <br />THOMAS JEFFERSON CHAMBERS LEAGUE, ABSTRACT NO.2, TRACT 2: <br />0.610 OF ONE ACRE (26,572 SQUARE FEET) OF ABSTRACT 2 AND TRACT <br />3: 0.642 OF AN ACRE OF LAND TO THE CITY OF SAN MARCOS, HAYS <br />COUNTY, TEXAS, LOCATED AT 1331-1425 RANCH ROAD 12, AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Moore requested this land use amendment and the following zoning <br />amendment public hearings be considered simultaneously before <br />Council action on either item. Mayor Morris opened the public <br />hearing and asked if anyone wished to speak for or against the land <br />use amendment. Ofelia Vasquez-Philo stated she is a resident of <br />Park Place Neighborhood, and the neighborhood opposes this amendment <br />to Commercial but would approve Office Professional. O. A. Watson <br />stated he is one of the owners of the property in question and is <br />the spokesperson for the owners. He stated he has worked with Jeff <br />Kester on a plan of development, and that he thinks it fits in the <br />Master Plan use of the property on Ranch Road 12. He stated the <br />property borders the City Cemetery, Franklin Drive and Park Place. <br />He wants to relocate his office in this development. Mr. Hart and <br />Mayor Morris stated the conversations they have had with area <br />residents express fear of the unknown in what could be developed <br />with the Commercial designation. Mr. Moore stated the traffic <br />pattern of a commercial development was also a concern that has been <br />expressed. R. G. Phillips, a resident of Franklin Drive, stated he <br />knows of one Franklin Drive resident who opposes this land use <br />change, and that he also opposes it. No one else wished to speak, <br />so Mayor Morris closed the public hearing. The City Council stated <br />if Dr. Watson goes through the land use and zoning process again for <br />another designation, that they want to waive the fees of the process <br />for him. <br /> <br />Mayor Morris introduced for consideration adoption of a Zoning <br />Ordinance, the caption which was read as follows; <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY ZONING <br />LOTS 4-8, OUT OF THE PERKINS ADDITION TO THE CITY OF SAN <br />MARCOS, AS RECORDED IN VOLUME 165, PAGE 220 OF THE HAYS COUNTY <br />DEED RECORDS, TOGETHER WITH THREE UNPLATTED TRACTS OF LAND, AS <br />FOLLOWS: TRACT 1: 0.580 ACRE OUT OF THE THOMAS JEFFERSON <br />CHAMBERS LEAGUE, ABSTRACT NO.2, HAYS COUNTY, TEXAS, BEING ALL <br />OF LOT 1 OF THE UNRECORDED PERKINS SUBDIVISION; TRACT 2: 0.610 <br />ACRE WITHIN THE THOMAS JEFFERSON CHAMBERS SURVEY, ABSTRACT 2, <br />CITY OF SAN MARCOS, HAYS COUNTY, TEXAS, BEING ALL OF LOT 2 OF <br />THE UNRECORDED PERKINS SUBDIVISION; AND TRACT 3: 0.642 ACRE <br />BEING THE SAME LAND CALLED 0.64 OF AN ACRE IN A CONVEYANCE FROM <br />JACK W.
