<br />75 <br /> <br /> <br /> <br />Regular Meeting November 5, 1990 Page 6 <br /> <br /> <br />STREET; AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT; <br />AND DECLARING AN EFFECTIVE DATE. <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AUTHORIZING THE SUBMISSION OF A GRANT APPLICATION TO THE <br />FEDERAL AVIATION ADMINISTRATION FOR IMMEDIATE FUNDING FOR <br />RUNWAY LIGHTING SYSTEM REPAIRS AT THE SAN MARCOS MUNICIPAL <br />AIRPORT; AUTHORIZING THE CITY MANAGER TO EXECUTE THE <br />APPLICATION AND ALL OTHER DOCUMENTS INCIDENT TO THE PURPOSES OF <br />THE PROPOSED GRANT PROJECT; AUTHORIZING THE ACCEPTANCE OF THE <br />GRANT IF THE APPLICATION IS APPROVED AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, SUPPORTING THE TEXAS MUNICIPAL LEAGUE'S PROPOSED <br />AMENDMENTS TO TEXAS LOCAL GOVERNMENT CODE CHAPTER 143 <br />(MUNICIPAL CIVIL SERVICE ACT) TO RESTORE PROPER AND EFFECTIVE <br />MANAGEMENT TO POLICE AND FIRE DEPARTMENTS; ENCOURAGING THE <br />VARIOUS LEGISLATORS REPRESENTING THE SAN MARCOS AREA TO ADOPT <br />AND SUPPORT SUCH LEGISLATION; AND PROVIDING AN EFFECTIVE DATE. <br /> <br />Mayor Morris introduced for consideration Item 8.C.(1) removed from <br />the consensus agenda, approval of an Ordinance on second reading, <br />the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING CHAPTER 3, ANIMALS AND FOWL, OF THE SAN MARCOS <br />CODE OF ORDINANCES, PROVIDING FOR SEVERABILITY; REPEALING ALL <br />CONFLICTING ORDINANCES; PROVIDING A PENALTY; PROVIDING FOR <br />PUBLICATION AND PROVIDING AN EFFECTIVE DATE. <br /> <br />Mr. Moore moved to approve the Ordinance on second reading and Ms. <br />Kissler seconded the motion. Gail Fields recommended the Council <br />not restrict the number of pets that could be allowed and suggested <br />wording to control animal wastes. Mayor Morris moved to amend <br />Section 3-45(a) to delete Subsection (a) and reletter Subsections <br />(b) and (c) to (a) and (b); and amend section 3-48 as follows: "(a) <br />No owner or handler of any animal shall fail to promptly remove and <br />dispose of in a sanitary manner, excreta deposited by the animal on <br />any public property or private property including the property of <br />the owner. <br /> <br />"(b) It shall be unlawful for any owner or handler of an animal to <br />fail to keep the premises where the animal is kept, free from odors <br />to the extent that the odors are disturbing to any person residing <br />within reasonable proximity of the premises. <br /> <br />"(c) It shall be unlawful to allow animals or premises where animals <br />are kept to become infested with fleas, ticks or other vermin, by <br />failing to diligently and systematically apply accepted methods of <br />insect and parasite control," and Ms. Kissler seconded the motion, <br />which passed unanimously. Mr. Moore moved to ~mend Section 3-46(b) <br />as follows: ". . . dangerous reptile unless licensed to do so by <br />the Texas Parks and Wildlife Department for rehabilitation <br />purposes," and Mayor Morris seconded the motion, which passed <br />unanimously. The Council then voted unanimously for approval of the <br />Ordinance on second reading. <br /> <br />Mayor Morris introduced for consideration Items 8.C.(2) removed from <br />the consensus agenda, approval of an Ordinance on second reading, <br />the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, ESTABLISHING FEES IN COMPLIANCE WITH THE PROVISIONS OF <br />THE SAN MARCOS CODE OF ORDINANCES, CHAPTER THREE, ANIMALS AND <br />FOWL, AND DECLARING AN EFFECTIVE DATE. <br /> <br />Ms. Kissler moved for approval of the Ordinance on second reading <br />and Mr. Guerra seconded the motion. Gail Fields stated she was <br />opposed to a drop-off fee. Chief Martin stated it will generate <br />fees for responsible owners. The Council voted unanimously for <br />approval of the Ordinance on second reading. <br />
