Mr. Plummer moved to amend the <br />Ordinance to require permits only for barbed wire and electric <br />fences and Mr. Hart seconded the motion. On roll call the following <br />vote was recorded: <br /> <br />AYE: Hart, Morris, Guerra, Plummer. <br /> <br />NAY: Moore, Hernandez, Kissler. <br /> <br />ABSTAIN: None. <br /> <br />The motion passed. The Council then voted unanimously for approval <br />of the Ordinance on second reading. <br /> <br />Mayor Morris introduced for consideration Item 10.C.(1) removed from <br />the consensus agenda, adoption of an Ordinance on third and final <br />reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING CHAPTER 3, ANIMALS AND FOWL, OF THE SAN MARCOS <br />CODE OF ORDINANCES, PROVIDING FOR SEVERABILITY; REPEALING ALL <br />CONFLICTING ORDINANCES; PROVIDING A PENALTY; PROVIDING FOR <br />PUBLICATION AND PROVIDING AN EFFECTIVE DATE. <br /> <br />Mr. Moore moved for adoption of the Ordinance on third and final <br />reading and Ms. Kissler seconded the motion. Gail Fields provided <br />the Council with a portion of the City of Austin's Ordinance, the <br />section on dangerous animals or reptiles (the City of San Marcos' <br />Section 3-46 - Keeping of wild Animals). The Council discussed <br />Austin's wording of this Section, and Mr. Taylor stated there were <br />gaps in Austin's wording. Mayor Morris indicated she preferred the <br />City to research longer and amend our Ordinance at a later time if <br />needed rather than adopt Austin's wording. Becky Whitetower stated <br />she wanted to clarify with the Council it is not easy to obtain a <br />license for rehabilitation of animals. It is necessary to meet <br />requirements and undergo periodic checks by the State. Our City <br />Ordinance provides that the Municipal Court can determine that an <br />animal is vicious, and can have the animal declared vicious and <br />removed from the City. The Council voted unanimously for adoption <br />of the Ordinance on third and final reading. <br /> <br />Mayor Morris introduced for consideration Item 10.C.2 removed from <br />the consensus agenda, adoption of an Ordinance on third and final <br />reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, ESTABLISHING FEES IN COMPLIANCE WITH THE PROVISIONS OF <br />THE SAN MARCOS CODE OF ORDINANCES, CHAPTER THREE, ANIMALS AND <br />FOWL, AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Guerra moved for adoption of the Ordinance on third and final <br />reading and Ms. Kissler seconded the motion. Gail Fields offered <br />amendments to the drop-off fee. Following a discussion Mr. Hart <br />moved to amend the Ordinance for the drop-off fee for City residents <br />to be a $5.00 donation and $10.00 per litter and a $10.00 drop-off <br />fee for residents outside the City limits, and Mr. Moore seconded <br />the motion, which passed unanimously. The Council then voted <br />unanimously for adoption of the Ordinance on third and final <br />reading. <br /> <br />Mayor Morris introduced for consideration Item 10.D.(1) removed from <br />the consensus agenda, adoption of a Resolution, the caption which <br />was read as follows: <br /> <br />A RESOLUTION AUTHORIZING THE SUBMISSION OF A REVISED MAP TO THE <br />TEXAS WATER COMMISSION BY THE DIRECTOR OF PUBLIC WORKS IN <br />CONNECTION WITH THE CITY'S PENDING APPLICATION FOR AMENDMENT OF <br />ITS CERTIFICATE OF CONVENIENCE AND NECESSITY; AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />Mr. Guerra moved for adoption of the Resolution and Mr. Hart <br />seconded the motion.
