<br />19 <br /> <br /> <br /> <br />Regular Meeting December 17, 1990 Page 2 <br /> <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, PROVIDING FOR ISSUANCE OF A PERMIT FOR CERTAIN ALARM <br />SYSTEMS; PROVIDING FOR SERVICE FEES FOR CITY RESPONSES TO <br />EXCESSIVE FALSE ALARMS; PROVIDING FOR REVOCATION OF PERMITS; <br />PROVIDING STANDARDS FOR ALARM PROTECTIVE SERVICES AND ALARM <br />SYSTEM OPERATION; PROVIDING FOR SEVERABILITY; REPEALING ALL <br />CONFLICTING ORDINANCES; PROVIDING A PENALTY; PROVIDING FOR <br />PUBLICATION; AND PROVIDING AN EFFECTIVE DATE. <br /> <br />Ms. Kissler moved for adoption of the Ordinance on third and final <br />reading and Mr. Moore seconded the motion. Mr. Moore moved to amend <br />the Ordinance as follows: (1) Section 16-63(3) to add a <br />subdivision (C) to read as follows: "(C) An alarm system which <br />provides notice of activation only to persons on the premises served <br />by the alarm system;" (2) Section 16-63(8) to amend the first <br />paragraph to read as follows: "False alarm shall mean any <br />activation of an alarm system through mechanical or electronic <br />failure, malfunction, improper installation, negligence of the <br />owner, agent or person in control of the property, or any other <br />activation to which ~ police officer or firefighter responds and <br />finds no evidence of an emergency for which the alarm system was <br />designed to give notice;" (3) Section 16-4(h) in the third line, the <br />words "required if" should be transposed to read "if required;" and <br />(4) Section 16-66(b) at the end of the first line, the word "revoke" <br />should be "revokes," and Mr. Guerra seconded the motion, which <br />passed unanimously. Mr. Moore moved to amend Section 16-64(h) for <br />the annual permit fee to be $10.00 and Ms. Kissler seconded the <br />motion, which passed unanimously. Mr. Moore moved to amend Section <br />16-65(a) for a sliding scale for false alarms as follows: 0-6 in 12 <br />months, no charge; 7-9 in 12 months, $30.00 each; 10-12 in 12 <br />months, $60.00 each; and more than 12 in 12 months, $100.00 each, <br />and Mr. Hernandez seconded the motiøn, which passed unanimously. <br />The Council then voted unanimously for adoption of the Ordinance. <br /> <br />Mayor Morris introduced for consideration reconsideration of three <br />Zoning Ordinances. The Council did not wish to reconsider any of <br />these Ordinances. The captions of these Ordinances read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING <br />LOT 1, BLOCK 1 OF INTERNATIONAL ELECTRIC CORPORATION ApDITION <br />TO THE CITY OF SAN MARCOS, HAYS COUNTY, TEXAS, LOCATED AT 2809 <br />IH35 SOUTH, FROM "I" (INDUSTRIAL DISTRICT) TO "LI" (LIGHT <br />INDUSTRIAL DISTRICT), AND DECLARING AN EFFECTIVE DATE. <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY ZONING <br />7.881 ACRES, LOCATED AT 1612 AQUARENA SPRINGS, FROM "C" <br />(COMMERCIAL DISTRICT) AND "M" (SINGLE-FAMILY, DUPLEX AND <br />NEIGHBORHOOD BUSINESS DISTRICT) TO "MF-4" (MULTI-FAMILY <br />DISTRICT [HIGH DENSITY]), AND DECLARING AN EFFECTIVE DATE. <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY ZONING A <br />20,606.511 SQUARE FOOT TRACT OF LAND, BEING PARTS OF LOTS 12 <br />AND 13, BLOCK 6 OF THE ORIGINAL TOWN OF SAN MARCOS, HAYS <br />COUNTY, TEXAS, AS RECORDED IN VOLUME 46, PAGE 448 OF THE HAYS <br />COUNTY DEED RECORDS, LOCATED AT 112 C. M. ALLEN PARKWAY, FROM <br />"I" (INDUSTRIAL DISTRICT) TO "C" (COMMERCIAL DISTRICT), AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />Mayor Morris introduced for consideration approval of minutes of the <br />Regular Meeting held December 10, 1990, adoption of three Ordinances <br />on third and final reading and adoption of five Resolutions on <br />consensus. The Council removed Item 7.B.(1) from the consensus <br />agenda. Ms. Kissler moved to approve the minutes of the Regular <br />Meeting held December 10, 1990, to approve the two remaining <br />Ordinances on third and final reading and to adopt the five <br />Resolutions by consensus and Mr. Plummer seconded the motion, which <br />passed unanimously.
