<br />55 <br /> <br />regular meeting <br /> <br />january 26, 1981 <br /> <br />page three <br /> <br />On roll call, the following vote was recorded: <br /> <br />AYE: <br /> <br />Cavazos, James, Kraus, Norris, Tarbutton <br /> <br />NAY: <br /> <br />Brown <br /> <br />The Mayor introduced for consideration a public hearing to consider zoning <br />30 acres out of the River Run Subdivision, located on River Road, from <br />"AO" (Agricultural-Open Space District) t.o "D" (Multi-Family Dwelling <br />District). The Mayor then opened the public hearing. No one wished to <br />speak either for or against the proposed zoning. The Mayor then closed <br />the public hearing and stated that it would be continued at the February <br />9th meeting. <br /> <br />The Mayor then introduced for consideration a public hearing and first <br />reading of the zoning of 22.255 acres out of the J.M. Veramendi League No. <br />Two, from "AO" (Agricultural-Open Space District) to "c" (Commercial). <br />The Mayor then opened the public hearing. Jake Krauskopf, the applicant, <br />gave the location of the property to the Council. Mr. James asked about <br />right-of-way acquisition. Mr. Krauskopf stated that the owner was aware <br />of the right-of-way need by the City. Mr. Brown stated his concern about <br />the available utilities and that the property was in the floodway. No one <br />else wished to speak either for or against the proposed zoning. The Mayor <br />then closed the public hearing. The City Manager stated that the owner of <br />the property would be responsible for utilities and that possibly in the <br />future a bond program could be considered. The City Secretary then read <br />the Ordinance in its entirety, the caption of which follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING SECTION 3 OF THAT ORDINA.NCE WHICH REGULATES AND RESTRICTS <br />THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED <br />SEPTEMBER 29, 1980 (VOL. 54) BY ZONING 22.255 ACRES OUT OF THE J.M. <br />VERAHENDI LEAGUE NO. TWO, FROH "AO" (AGRICULTURAL-OPEN SPACE DISTRICT <br />TO " C " ( COM1'iERC IAL) . <br /> <br />Mrs. Norris moved to approve the Ordinance on first reading. Mr. James <br />seconded the motion. On roll call, the following vote was recorded: <br /> <br />AYE: <br /> <br />Brown, Cavazos, James, Norris, Tarbutton <br /> <br />NAY: <br /> <br />None <br /> <br />ABSTAIN: <br /> <br />Kraus <br /> <br />A statement as to why the Mayor abstained on this vote is attached and made <br />a part of these minutes. <br /> <br />The Mayor introduced for consideration a public hearing and first reading <br />on changing the zoning of 1 acre out of the A.W. withers Suburban Sub- <br />division, located at the corner of Ranch Road 12 and Bishop St., from "R-l" <br />(Single Family Residential) to "c" (Commercial). The M.ayor then opened <br />the public hearing. Marcos Vargas, representing the owner, stated that this <br />was the best zonin~ for this piece of property. Mr. Brown asked about the <br />possible connection of Bishop and LBJ being a problem at this point. The <br />City Mana~er stated that the connection would be done on the LBJ side of <br />Ranch Road 12 and that the use of a lift station to force sewage into the <br />city line may be requiLed. Mr. Vargas said that the owner was aware of the <br />right-of-way acquisition requested by the City. The Mayor stated that the <br />owner should check on the grade of the sewer also. The Mayor then closed <br />the public hearing. The City Secretary then read the Ordinance in its <br />entirety, the caption of which follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />NlENDING SECTION 3 OF 'I'HA TORDINANCE WHICH REGULATES AND RESTRICTS <br />THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED <br />SEPTEMBER 29, 1980 (VOL. 54) BY CHANGING THE ZONING OF 1 ACRE OUT <br />OF THE A.W. WITHERS SUBURBAN SUBDIVISION, LOCATED AT THE CORNER OF <br />RANCH ROAD 12 AND BISHOP ST., FROM "R-l" (SINGLE FAMILY RESIDENTIAL) <br />TO "c" (COMMERCIAL). <br /> <br />Mrs. Norris moved to approve the Ordinance on first reading. <br />seconded the motion, which passed unanimously. <br /> <br />Mr. James <br />
