<br />56 <br /> <br />regular meeting <br /> <br />january 26, 1981 <br /> <br />;?age four <br /> <br />The Mayor introduced for consideration a public hearing to consider the <br />annexation of approximately 86 acres, more or less, out of the J.M. <br />Veramendi League No.1 and 2, bounded by existing city limits line of I.H. <br />35 on the northwest, the existing city limits line along River Road (old <br />S.H. 80) on the east and northeast, by the north line of the existing <br />county road on the southeast and by the existing city limits line on the <br />extension of Flores Drive on the southwest. The Hayor then opened the <br />public hearing. Andrew Gary, representing the owners, addressed the Council <br />in opposition to the proposed annexation. He stated that the Council <br />should not annex the property unless there was some substantial reason <br />for doing so. He stated that there was no tax incentive for bringing <br />it into the City and that it would cost more than it was worth and that <br />this would be another piece of property which would have to have utiliti~ci <br />provided to within 3 years. Hr. James stated that he did not see what <br />hardships the annexation would cause. He asked staff to check on open <br />space classifications since no rental fees are charged for use of the camp. <br />The Mayor then closed the public hearing. Mrs. Norris stated that she <br />wanted the bridge and Thompson Island included in the proposed annexation. <br />The City Manager pointed out to Council that in order to include the bridge <br />and island in the proposed annexation, another public hearing would have <br />to be held. Mr. Cavazos moved to include the bridge and island in the <br />proposed annexation and to call another public hearing. Mrs. Norris secondel <br />the motion, which passed unanimously. <br /> <br />The Mayor introduced for consideration an Ordinance on emergency amending <br />Division 2 entitled "Texas Municipal Retirement System" read in its entirety <br />the caption of which follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN HARCOS, TEXAS, <br />AHENDING DIVISION 2, ENTITLED "TEXAS MUNICIPAL RETI~EMENT SYS1'EM" <br />OF C!'-IAPTER 2, ENTITLED "ADHINISTRATION" OF THE CODE OF ORDINANCES <br />OF SAID CITY BY ALLOWING CERTAIN EMPLOYEES OF SAID CITY ívHO HAVE <br />TERMINATED PREVIOUS JI1EHBERSHIPS IN TEXAS MUNICIPAL RETIREMENT SYSTEM, <br />TO DEPOSIT THE SUMS SO WITHDRAWN, PLUS ANNUAL hfITHDRAí.vAL CHARGEE <br />AND BY ALLOWING AND UNDERTAKING THE COST OF ALLOWING ANY SUCH <br />EMPLOYEE CREDIT IN SUCH SYSTEM FOR ALL SERVICES TO WHICH SUCH <br />EMPLOYEE HAD BEEN ENTITLED AT DATE OF SUCH ívITHDRAWAL, WITH LIKE <br />EFFECT AS IF ALL SUCH SERVICE HAD BEEN PERFORMED AS AN EMPLOYEE OF <br />THIS CITY AND DECLARING AN EMERGENCY. <br /> <br />Mrs. Norris moved to adopt the Ordinance on emergency. <br />the motion, which passed unanimously. <br /> <br />Mr. James seconded <br /> <br />The Mayor introduced for consideration a Resolution approving a lease <br />between the City and Miller Air Sports, Inc., the caption of which was <br />read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING A LEASE OF A PORTION OF SAN MARCOS MUNICIPAL AIRPORT TO <br />MILLER AIR SPORTS, INC. FOR THE PURPOSE OF BUILDING AND ASSEMBLING <br />HOrilEBUILT AIRCRAFT AND AS HEADQUARTERS FOR THE TEXAS CHAMPIONSHIP <br />AIR RACES AND OTHER AVIATION RELATED ACTIVITIES; AUTHORIZING THE <br />MAYOR TO EXECUTE A LEASE AGREE~1ENT AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Cavazos moved to adopt the Resolution. <br />which passed unanimously. <br /> <br />Mr. James seconded the motion, <br /> <br />The Mayor introduced for consideration a Resolution approving a release <br />of a portion of an easement granted to the City by Robert and Theresa <br />Kone, the caption of which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF' THE CITY OF SAN l'ffiRCOS, TEXAS, <br />APPROVING A RELEASE OF' A PORTION OF AN EASEJI1ENT GRANTED TO CITY BY <br />ROBERT M. KONE AND THERESA K. KONE AND RECORDED IN VOLUME 176, PAGE <br />495, HAYS COUNTY DEED RECORDS; AUTHORIZING THE MAYOR OF SAID CITY <br />TO EXECUTE SAID RELEASE AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mrs. Norris moved to adopt the Resolution. <br />which passed unanimously. <br /> <br />Mr. Brown seconded the motion, <br />
