Qcd o — 0 ORDINANCE NO. 2004 - ti4 c W M, J " c } W AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF L o SAN MARCOS, TEXAS, AMENDING SECTION 2.172 OF THE a v Y CITY CODE TO CHANGE THE FREQUENCY WITH WHICH a v THE SUNSET ADVISORY COMMISSION IS APPOINTED; AND INCLUDING PROCEDURAL PROVISIONS. RECITALS: 1. The Sunset Advisory Commission, in its June 14, 2004 report to the City Council, recommended that the City Council change the time interval at which the Sunset Advisory Commission is required to be appointed. 2. The City Council wishes to implement this recommendation of the Sunset Advisory Commission. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. Section 2.172 of the City Code is amended as follows (underlining indicates added text, eke indicates deleted text): See. 2.172. Composition; appointment of members; officers. (a) The sunset advisory commission is established every4hfee five years, composed of seven citizens of the city who are appointed by the city council for terms not to exceed 12 months. (b) The commission members will elect a chairperson and vice - chairperson within 30 days after their appointment. The commission may elect from its membership other officers and committees as it may, from time to time, determine necessary for the proper performance of its duties. SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion. SECTION 3. All ordinances and resolution or parts of ordinances or resolutions in conflict with this ordinance are repealed. SECTION 4. This Ordinance will take effect ten days after the date of its final passage, and the City Clerk will publish notice of its adoption in a newspaper of general circulation in the City. 1
