All heavy truck traffic will be directed to use the entrance I exit driveways onto <br />Stagecoach Trail. <br /> <br />4.07. All retail and commercial customers will be directed to use the two driveways onto <br />Wonder WorId Drive. <br /> <br />4.08. All run-off water will be collected into the two detention ponds as shown on the attached <br />land use plan. <br /> <br />4.09. Lighting will be provided in both the parking and yard areas, designed to minimize effect <br />on adjoining properties. <br /> <br />4.10. The height of buildings will be limited to 40 feet. <br /> <br />4.11. The primary free-standing sign on 'Wonder World Drive wilì be no higher than 35', or the <br />current applicable height restriction. The primary free-standing sign located on Stagecoach Road <br />will be a 6' 1" x 5' monument type sign constructed of limestone rock. <br /> <br />4.12. The dumpsters will be located within the screened-in rear area of the site. <br /> <br />4.13. There shall be no outside display of merchandise within lOO' of the Wonder World Drive <br />property line. <br /> <br />Part 5. Miscellaneous <br /> <br />5.01. The Property Owner understands and acknowledges that the Project Site will be bound by <br />the provisions of these development standards as though they were conditions, restrictions and <br />limitations on use of the Project Site under the City's zoning ordinance. <br /> <br />5.02. The Property Owner wlderstands and acknowledges that any person, firm, corporation or <br />other entity violating any provisions of these development standards shall be subject to all <br />penalties that apply to violation of the zoning ordinances of the City of San Marcos, as amended. <br />The Property Owner further understands and acknowledges that any person, firm, corporation or <br />other entity violating any provisions of these development standards shall be subject to a suit by <br />the City for an injunction to enjoin the violation oÎ these development standards as though they <br />were conditions, restrictions and limitations on use of the Project Site under the City's zoning <br />ordinance. <br /> <br />5.03. All obligations of the Property Owner created under these development standards are <br />performable in Hays County, Texas and venue for any action arising under these development <br />standards shall be in Hays County, Texas. These development standards will be construed in <br />accordance with the laws of the State of Texas. <br /> <br />5.04. Nothing in these development standards, express or implied, is intended to confer any <br />rights, benefits or remedies under or by reason of these development standards upon any person <br />or entity other than the City of San Marcos. <br /> <br />3 <br />
