responsibilities and limitations of authority of the Engineer as the City's representative during <br />construction will not be modified or extended after the construction contract documents have <br />been authorized by the City to be competitively bid without written consent of the City and the <br />Engineer and with notice to the Contractor. <br />1.7 ADDITIONAL SERVICES/CHANGE IN SERVICES <br />1.7.1 The City may direct the Engineer to perform services outside of the scope of the Basic <br />Services described in Sections 1.1 through 1.6 above. The Engineer will submit a written <br />estimate of fees to the City and obtain the City's authorization before initiating any additional <br />services. The following services are specifically considered to be additional services: <br />a) Right of way/easement acquisition services; <br />b) Services related to the design for pavement, sidewalk, ADA ramps, or other <br />improvements beyond those described for the drainage design in this scope of <br />services are not included and will be provided as an amendment to this contract; <br />c) Environmental services such as historical, archeological, evaluation or mitigation <br />of environmental impacts to the San Marcos River or other areas associated with <br />the project improvements; <br />d) Services resulting from significant changes in the general scope, extent, or <br />character of the project or scope of work, and revising previously accepted <br />studies, reports, design documents, or contract documents when such revisions are <br />required by changes in laws, rules, regulations, ordinances, codes, or orders <br />enacted subsequent to the preparation of such studies, reports, or documents, or <br />are due to any other causes beyond the Engineer's control; <br />e) It is assumed that the geotechnical investigation and topographical surveying <br />performed during the preliminary phase(s) of this project is adequate and no <br />additional geotechnical field investigations are included in this proposal; <br />f) Perform bank or channel stabilization for the outfall channel entering the San <br />Marcos River; <br />g) Preparing to serve or serving as a witness for the City in any litigation, arbitration, <br />or other legal or administrative proceeding; <br />h) Revisions, additions, and changes to design(s) due to citizen advisory or oversight <br />groups; <br />i) Preparation of Federal Emergency Management Agency submittals, U.S. Army <br />Corps of Engineers Section 404 Permit submittals, and Environmental Protection <br />Agency storm water permit documents; <br />j) Services in connection with City initiated work directive changes and change <br />orders that constitute additional design services through no fault of the Engineer; <br />k) Assisting the City in determining what additional information on Contractor <br />qualifications may be required to be submitted by the bidders with their bids; <br />1.7.2 Each material change (deletion or addition) in the services to be provided by Engineer <br />HNTB Agreement -Hutchison Drainage <br />10 <br />
