GENERAL CERTIFICATE OF THE CITY OF SAN MARCOS TEXAS <br />CITY OF SAN MARCOS § <br />COUNTIES OF HAYS, CALDWELL AND GUADALUPE § <br />STATE OF TEXAS § <br />We, the undersigned Mayor and City Clerk of the City of San Marcos, Texas (the "City"), <br />DO HEREBY CERTIFY as follows: <br />l . Benefit and Capitalized Terms. This certificate is executed for and on behalf of the <br />City, for the benefit of the Alliance Regional Water Authority (the "Authority"), the Attorney <br />General of the State of Texas and for the benefit of the Texas Water Development Board in <br />connection with the issuance of the Bonds. Unless otherwise defined herein, the capitalized terms <br />used in this Certificate shall have the meanings whenever they are used given in Exhibit "A" <br />attached hereto. <br />2. Relative to Incorporation. The City is a home -rule municipality, operating and <br />existing under the Texas Constitution and laws of the State of Texas and the City's Home Rule <br />Charter. There have been no changes or amendments to the City's Home Rule Charter since the <br />last issuance of obligations by the City submitted to the Attorney General to wit: Combination Tax <br />and Revenue Certificates of Obligation, Series 2024. <br />3. Relative to No -Default. Exhibit "B" attached hereto reflects all of the bonds and <br />other obligations of the City's System. The City is not in default as to any covenant, condition or <br />obligation contained in the ordinances or resolutions authorizing the issuance of the outstanding <br />obligations of the City's System shown on Exhibit "B"; and there is on hand in the special funds <br />created for the payment and security of the aforesaid obligations the amounts now required to be <br />on deposit therein. <br />4. Relative to Rate and Charges. The rates now being charged by the City for water <br />and sewer services provided by the City's System are as shown on Exhibit "C" attached hereto. <br />5. Relative to City Officials. The duly qualified and acting officials of the City are as <br />follows: <br />Jane Hughson <br />Mayor <br />Matthew Mendoza <br />Council Member Place 1 <br />Saul Gonzales <br />Council Member Place 2 <br />Alyssa Garza <br />Council Member Place 3, Mayor Pro Tem <br />Shane Scott <br />Council Member Place 4 <br />Lorenzo Gonzalez <br />Council Member Place 5 <br />Amanda Rodriguez <br />Council Member Place 6 <br />6. Relative to City's System.
