PROPOSED PROJECT TIMETABLES <br />ENTITLEMENT TIMETABLE <br />The City of San Marcos has received an application for a development agreement (the <br />"Development Agreement") for the Hopson and Nicolai Parcels which are located outside <br />the City Limits, but within the extraterritorial jurisdiction (ETJ) of the City. The City <br />Council authorized negotiations on April 6, 2021. <br />a. The Development Agreement shall include annexation terms which require <br />annexation concurrent with the City Council approval: of (i) the issuance of PID <br />bonds; and (ii) zoning approvals of the NOB Parcel. <br />b. The Development Agreement shall substantively mirror the provisions of the <br />Whisper Texas Planned Development District as it relates to development standards <br />for the Whisper South development. <br />c. Development Agreement negotiation shall conclude no later than six (6) months <br />following commencement, unless otherwise directed by the Whisper South City <br />Council Committee. <br />2. Within 10 business days of the establishment of the PID boundaries by action of the City <br />Council, the Developer shall submit the appropriate applications to initiate zoning changes <br />for the portion of the Project located within the City Limits. <br />a. Zoning change requests shall receive final action of the City Council no later than <br />six (6) months following the submittal of a complete application. <br />Within 10 business days of the formation of the PID by action of the City Council, the <br />Developer shall submit a formal request for the entire NOB Parcel (216 acres) to be served <br />by the City of San Marcos Water CCN. City and Developer acknowledge and agree that <br />the remainder of the Whisper South PID will be located within the Maxwell Special Utility <br />District ("Maxwell SUD") CCN. <br />a. Said letter shall include a metes and bounds description of the entire NOB Parcel, <br />some of which is not currently served by a water CCN. <br />4. Within 10 business days of the formation of the PID by action of the City Council, the <br />Developer shall submit a formal request to be served by the City of San Marcos Wastewater <br />CCN. City and Developer acknowledge and agree that the entire Whisper South PID will <br />be serviced and located within the City of San Marcos Wastewater CCN. <br />a. Said letter shall include a metes and bounds description of the area currently not <br />served by a wastewater CCN. <br />PID Petition 13 <br />
