Federalcontract,grantoranyotherawardcoveredby31U.S.C.1352. <br />G. SECTION3TERMSANDCONDITIONSCLAUSE <br />EconomicOpportunitiesforSection3ResidentsandSection3BusinessConcerns <br />1) TheworktobeperformedunderthisContractissubjecttotherequirementsofsection3ofthe <br />HousingandUrbanDevelopment(HUD)Actof1968,asamended,12U.S.C1701u(section3).The <br />purposeofsection3istoensurethatemploymentandothereconomicopportunitiesgeneratedby <br />HUDassistanceorHUDassistedprojectscoveredbysection3,shall,tothegreatestextentfeasible,be <br />directedtolowandverylowincomeperson,particularlypersonswhoarerecipientsofHUDassistance <br />forhousing. <br />2) ThepartiestothisContractagreetocomplywithI <br />5͸ƭregulationsin24CFRpart75,whichimplement <br />section3.AsevidencedbytheirexecutionofthisContract,thepartiestothisContractcertifythatthey <br />areundernocontractualorotherimpedimentthatwouldpreventthemfromcomplyingwiththepart <br />75regulations. <br />3) TheContractoragreestoincludethissection3clauseineverysubcontractsubjecttocompliancewith <br />regulationsin24CFRpart75,andagreestotakeappropriateaction,asprovidedinanapplicable <br />provisionofthesubcontractorinthissection3clause,uponafindingthatthesubcontractorisin <br />violationoftheregulationsin24CFRpart75.TheContractorwillnotsubcontractwithany <br />subcontractorwheretheContractorhasnoticeorknowledgethatthesubcontractorhasbeenfound <br />inviolationoftheregulationsin24CFRpart75. <br />4) TheContractorwillcertifythatanyvacantemploymentpositions,includingtrainingpositions,thatare <br />filled(1)aftertheContractorisselectedbutbeforethecontractisexecuted,and(2)withpersonsother <br />thanthosetowhomtheregulationsof24CFRpart75requireemploymentopportunitiestobe <br />directed,werenotfilledtocircumventthe/ƚƓƷƩğĭƷƚƩ͸ƭobligationsunder24CFRpart75.Minimum <br />expectationsofefforttodirectemploymentopportunitiestosuchworkersareidentifiedintheSection <br />3Plan. <br />5) NoncompliancewithI <br />5͸ƭregulationsin24CFRpart75mayresultinsanctions,terminationofthis <br />Contractfordefault,anddebarmentorsuspensionfromfutureHUDassistedcontracts. <br />H. COMPLIANCEWITHRULESANDREGULATIONS <br />FundingfortheProjecthasbeenmadeavailablebyHUDthroughtheCDBGDRProgram.TheContractor <br />willcomplywithalloftheapplicableuniformadministrativeregulationsrelatedtotheapplication, <br />acceptanceanduseoffederalfundsascontainedin2CFRPart200,UniformAdministrativeRequirements, <br />CostPrinciples,andAuditRequirementsforFederalAwards.TheContractorisencouragedtoobtainthe <br />necessaryinformationbutfailuretodosowillnotrelieveitfromcompliancewiththeapplicable <br />regulations.TheContractorwillberesponsibleforcomplianceandconformancewithapplicablefederal <br />andstatelaws,rules,regulationsandcodes,Citypermittingrequirements,andCityordinancescurrently <br />ineffect.Federalandstatelaws,rules,regulationsandcodesincludebutarenotlimitedto: <br />a.
