<br />provisions of this Agreement. <br />Lessee shall maintain the Leased Premises and the Equipment in good condition, free <br />from trash, debris, and obvious signs of deterioration. <br />3. Access to Leased Premises: <br />a. Lessee shall have the unrestricted right to enter or leave the Leased Premises where the <br />Equipment is located. In accessing the Leased Premises, however, Lessee agrees to <br />remain within the LCRA transmission line easement area to the maximum extent <br />feasible, and Lessee shall be responsible for promptly repairing, to the satisfaction of the <br />Director, any rutting or other damage connected with Lessee's access to the Leased <br />Premises. Lessee agrees to take, at its expense, all measures and precautions (including <br />construction and maintenance of a perimeter fence around the Leased Premises of the <br />type depicted on the attached Exhibit B)necessary to render the Leased Premises and the <br />Equipment inaccessible to unauthorized persons. Lessor agrees that it will not give <br />unauthorized persons access to the Equipment. <br />Lessor agrees to provide Lessee with road access to the Property, and access to the <br />Leased Premises, throughout the tenn ofthis Agreement. <br />4. Governmental Approvals: <br />Lessee shall be solely responsible for receiving approval ITom all governmental and regulatory <br />authorities for the installation, use, maintenance, and removal of the Equipment upon the Leased <br />Premises. If Lessee is unable to secure or maintain all appropriate approvals, this Agreement <br />may be canceled by Lessee by providing 30 days written notice to Lessor and all advance rentals <br />paid by Lessee to Lessor shall be refunded. <br />5. Term: <br />The initial term ofthis Agreement begins (the "Commencement Date") on September 15,2003, <br />and the initial ternl ends on September 14, 2008. After the initial tenn of this Agreement, this <br />Agreement will automatically be renewed for one year periods unless one party notifies the <br />other, at least 180 days in advance of an anniversary date of the Commencement Date, of its <br />intention not to renew the Agreement. If such a notice is given, this Agreement is terminated on <br />that anniversary date. <br />6. Consideration: <br />As consideration for this Agreement, Lessee shall pay Lessor the sum of $500.00 per month <br />during the first year of this Agreement, payable by the fifth of each month for that month. For <br />subsequent years of this Agreement, the rental amount shall increase each year by three percent <br />per year over the previous year's amount. <br />7. Termination: <br />a.
