<br />Equipment or the Leased Premises for the purpose stated in this Agreement for a <br />continuous period of 90 days or more. <br />This Agreement may be terminated by either party upon default by the other party of any <br />of the covenants or conditions contained in this Agreement other than a default resulting <br />in the creation of conditions described in Section 7a. In the event of a default by a party, <br />the other party shall give the defaulting party written notice of default, and, upon the <br />defaulting party's failure to cure or remedy the default within fifteen (15) days following <br />receipt of notice, this Agreement shall terminate immediately without further notice to <br />the defaulting party. <br />Upon any termination of this Agreement, Lessee shall remove the Equipment, including <br />foundations or pads, from the Leased Premises within 15 days after the date of <br />termination. Lessee shall have no further claim, right, title or interest in or to any of the <br />Equipment remaining on the Leased Premises after that time, and Lessee agrees to pay to <br />Lessor all costs of removing the Equipment if Lessee fails to do so within the time <br />specified above. <br />Upon ninety (90) days' written notice by Tenant if the Property or the Antenna Facilities <br />are, or become unacceptable under Tenant's design or engineering specifications for its <br />Antenna Facilities or the communications system to which the AntelIDa Facilities belong. <br />8. Notices: <br />All notices to Lessor shall be in writing and shall be sent by certified mail, return receipt <br />requested, or by confirmed fax, addressed to the City Manager of the City of San Marcos, 630 <br />East Hopkins Street, San Marcos, TX 78666, Fax (512)396-4656. All notices to Lessee shall be <br />in writing and shall be sent by certified mail, return receipt requested, or by confirmed fax, <br />addressed to the Lessee at 12920 SE 38th St., Bellevue, W A 98006, Attn: Legal Dept. with a <br />copy to Attn: Lease Admin., Fax (425) 378-4040. Either party may designate a different <br />address!Fax number for notice by notifying the other party in writing. <br />9. Surrender of Leased Premises: <br />Lessee will quit and surrender the Leased Premises to Lessor at the expiration or any termination <br />of this Agreement peaceably, quietly and in as good order and condition as now exists, <br />reasonable use and wear excepted. <br />10. Nondiscrimination: <br />The Lessee shall not discriminate against any employee or applicant for employment because of <br />race, religion, sex, color, national origin, age or physical handicap. <br />11. Additional Payments by Lessee: <br />Lessee shall pay, in addition to the rental specified, all permit fees, license fees, and any and all <br />taxes required by law and/or by ordinances of the City of San Marcos, Texas, incurred or <br /> <br />b. <br /> <br />c. <br /> <br />d. <br /> <br />AU-1463J <br />Ground Lease <br /> <br />3 <br />
