occasioned by Lessee's installation, use, operation, maintenance and/or removal of the Equipment at, on, or ftom the Leased Premises. 12. Utilities: Lessee shall provide for extension and connection to the Leased Premises of all utility services used by Lessee in its own name, and shall promptly pay all bills for the services. 13. Hazardous Substances: Lessor is not aware of the presence of hazardous substances on the Leased Premises; however, Lessor makes no warranty to Lessee in this regard. Lessee agrees to investigate and remediate all spills and other releases of hazardous chemical substances and wastes on and adjacent to the Leased Premises for which the Lessee is responsible under applicable laws. 14. Indemnification: Lessee agrees to hold harmless, indemnifY and defend Lessor, and its officers, agents and employees ITom and against all losses, claims, liens, demands and causes of action of every kind including, but not limited to, the amounts of judgments, penalties, interest, court costs, legal fees and all other expenses occurring in connection with Lessee's use of the Leased Premises under this Agreement, except for claims arising solely ftom the gross negligence or willful misconduct of Lessor. Lessee agrees to investigate, respond to, and defend any such claims, demands, or suits at the sole expense of Lessee. The indemnity required by this Agreement shall not be limited by reason of the specification of any particular insurance coverage in this Agreement. Lessee will hold Lessor hannless for Lessee's actions, including its contractors, subcontractors, and consultants. 15. Insurance: a. The Lessee shall, at its own expense, purchase and maintain insurance to protect itself ftom claims which may arise out of its operations under this Agreement, whether the operations are by itself or by any subcontractor or by anyone directly or indirectly employed by any of them or by anyone for whose acts any of them may be liable. The amounts of insurance coverage shall be at least the following: (1) Workers' compensation insurance -statutory limits. (2) Comprehensive general liability insurance - $500,000/$1,000,000/$500,000 or $1,000,000 combined single linlit. The insurance coverage carried by Lessee shall be written so that the Lessor will be notified. in writing, in the event of cancellation or non-renewal at least 30 days prior to the action. The coverage shall also include a waiver of each party's rights of subrogation against the other party, except as to the workers' compensation coverage. Lessee shall file certificates of insurance with the Lessor prior to the expiration of the current insurance policy. Insurance certificates are subject to Lessor's prior approval. b.
