<br />III. Acceptance of the Drainage System Construction <br />City shall be responsible for maintenance of the Drainage System Improvements <br />depicted in Exhibit C to this Agreement, following final inspection and acceptance by the <br />City Engineer. The drainage area served by the Drainage System Improvements is <br />depicted in a Drainage System Plan attached as Exhibit D to this Agreement. <br />IV. Development of Marlton Estates During Construction of the Public <br />Improvements <br />Developer will be permitted to begin development of the Marlton Estates <br />Subdivision immediately upon execution of this Agreement. The plat of Marlton <br />Estates may be recorded prior to completion of the Public Improvements if all <br />other requirements of City's Land Development Code have been met and <br />Developer has posted the performance bond naming City as obligee as provided <br />in Article II of this Agreement.
