<br />K. The Phase 1 Engineer will provide periodic reports to the Parties at least monthly on the <br />progress of the Phase 1 Project and any revisions to the Phase 1 Project that have become <br />necessary. <br />L. The Phase 1 Engineer, through the Phase 1 Project Manager, will obtain the approval of all of <br />the Parties for all change orders which cause the original budget for construction cost to increase <br />by more than 5%. <br /> <br />1.4. Construction of Phase 1 Project. The Parties agree that the Phase 1 Project Manager will: <br />A. Obtain all necessary licenses and permits for the Phase 1 Project from authorities having <br />jurisdiction over the Phase 1 Project (including but not limited to the City and the Texas <br />Department of Transportation), and pay all fees related to such permits; <br />B. Procure and maintain commercial general liability insurance coverage insuring all of the Parties <br />with respect to all construction operations under the contract; <br />C. Solicit bids from qualified contractors; <br />D. Obtain the City's approval ofthe bidder to which the award is made; <br />E. Award a contract to the bidder whose bid represents the best value to the Parties, based on cost, <br />durability, and safety, and the qualifications and experience of the bidders; <br />F. Execute a contract with the Phase 1 Contractor for the construction of the Phase 1 Project; the <br />form of the contract will be subject to approval by the City, and the contract must include <br />requirements tlmt 1) the Phase 1 Contractor must maintain commercial general liability <br />insurance coverage insuring all of the Parties with respect to all of the Contractor's operations <br />and those of its subcontractors under the contract, 2) all persons engaged in work under the <br />contract must be covered by workers' compensation insurance, and 3) the Phase 1 Contractor <br />will indenmify and hold tlle Parties harmless for damages or injuries related to the construction <br />ofthe Phase I_Project; <br />G. Ensure that the Phase 1 Contractor constructs the Phase 1 Project in a good and workmanlike <br />manner; <br />H. Obtain a perfoffilance bond and a payment bond in the full amount of the construction contract <br />from the Phase 1 Contractor, naming the Phase 1 Project Manager and the City as obligees; <br />I. Submit invoices from the Phase 1 Engineer and the Phase 1 Contractor to the City for approval, <br />on forms approved by the City; submit approved invoices to the Parties; and submit requests for <br />payment to the Parties for their respective shares of payments due to the Phase 1 Engineer and <br />the Phase 1 Contractor in accordance with Paragraph 1.6 below; <br />J. Make payments to the Phase 1 Engineer and the Phase 1 Contractor as the payments become <br />due, subject to payment by the Parties of their respective shares of such payments under <br />Paragraph 1.6 below; <br />K. Submit change orders to the City for review and approval; and <br />L. Ensure that the Phase 1 Contractor completes the construction of the Phase 1 Project no later <br />than March 31,2004. <br /> <br />1.5. City Inspections and Acceptance of Phase 1 Project. The City agrees, at no cost to the other <br />'Parties, to perform the following with respect to the Phase 1 Project: <br />A. Inspect the construction of the respective Project as construction progresses; <br />B. Inspect the respective Project upon completion of construction; andjC.
