<br />194. <br />Regular Meeting <br /> <br />October 13, 2003 <br /> <br />Page 4 <br /> <br />Ms. Narvaiz moved for adoption of the Ordinance on third and final reading <br />and Mr. Taylor seconded the motion. Mr. Thomaides stated at the last <br />meeting Mr. Taylor read a list of city services these residents would no <br />longer receive. He stated these residents will no longer be able to serve <br />on Boards and Commissions as a City resident. He also stated these <br />residents will no longer be eligible for zoning, voting in City elections <br />and having City street-lights. Mr. O'Leary stated the City will no longer <br />pay for the electricity for street lights in this area. He stated these <br />lights can be paid for by the residents or the lights can be removed. Mr. <br />O'Leary also reminded the Council of the fire services for this area. He <br />stated if this disannexation is adopted then the South Hays County <br />Volunteer Fire Department will have to hold an election to put these areas <br />back into their service area. He also stated South Hays County Volunteer <br />Fire Department has agreed to provide fire protection during this interim <br />period. Mr. Mark Taylor stated this area would be in the City's ETJ which <br />means the Subdivision Rules will still be in effect. The Subdivision <br />Rules will still regulate lot sizes, width, setbacks for platting purposes <br />only, but property usage will be up to the individual owner. Ms. Narvaiz <br />inquired what the City is keeping. Mr. O'Leary stated the City is keeping <br />four subsections, B is 157 areas of Greenspace, C is 196 acres including <br />100 to 150 homes, E is 157 acres which includes 125 homes and Subsection D <br />is 350 acres including 100 homes with only one-third of the land being <br />developed. Mr. Taylor stated he had received a letter from Mr. Sones <br />requesting his and his neighbors' properties be included in this <br />disannexation. Mr. Taylor moved to amend the Ordinance to include lots <br />105 and 106 of willow Creek, Section III, and Mr. Montoya seconded the <br />motion. Ms. Narvaiz stated she felt this was too late in the process to <br />make this change. She stated she is concerned with other residents with <br />similar situations wanting to do the sarne thing. She felt these two lots <br />can be looked at when the Council discusses the Service Plans. Mr. <br />Montoya stated Mr. Sones had previously addressed this issue. He stated <br />these lots are on the same street as some of the other lots which are <br />being disannexed. Mr. Thomaides stated he could not support this <br />amendment. Mr. Mihalkanin stated he agrees with Mr. Montoya regarding Mr. <br />Sones request to review. He also stated the Council asked Staff to look <br />at whether these properties should be included. He feels to include these <br />properties now would be piecemeal. He also stated he feels this can be <br />discussed when Subsections D & E Service Plans are being considered. On <br />roll call on the arnendment, the following vote was recorded: <br /> <br />AYE: <br /> <br />Montoya and Taylor. <br /> <br />NAY: <br /> <br />Narvaiz, Thomaides, Mihalkanin and Habingreither. <br /> <br />ABSTAIN: <br /> <br />Diaz (disclosure affidavit-real property filed with City Clerk). <br /> <br />The motion failed. Mr. Mark Taylor <br />Tax Assessor, as well as the City's <br />taxes for this area. He stated the <br />pay taxes for this year. He stated <br /> <br />stated Staff has been working with the <br />Tax Attorney regarding the property <br />property owners will be required to <br />State Law does allow for these <br />
