Mr. O'Leary <br />stated he will not spend any money from this account without the Council's <br />approval. Mayor Habingreither stated this budget special increase from <br />$20,000 to $100,000 was to budget adequate funding for economic <br />development projects. The Council then voted unanimously for adoption of <br />the Ordinance on emergency. <br /> <br />Mayor Habingreither introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING CITY CODE SECTION 2.481 TO INCREASE THE FEE FOR BIRTH AND <br />DEATH CERTIFICATES BY ADDING A RECORDS PRESERVATION FEE; AND <br />INCLUDING PROCEDURAL PROVISIONS. <br /> <br />Ms. Narvaiz moved for approval of the Ordinance on first reading and Mr. <br />Taylor seconded the rnotion, which passed unanimously. <br /> <br />Mayor Habingreither introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS I <br />AMENDING CHAPTER 34, ENVIRONMENT, OF THE CITY CODE TO ADD SECTION <br />34.105 REGULATING CHARITABLE SOLICITATION ON PUBLIC STREETS; <br />INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />Ms. Narvaiz moved for approval of the Ordinance on first reading and Mr. <br />Taylor seconded the motion. Mr. O'Leary stated the Council requested some <br />amendments to this Ordinance to allow persons to solicit for charitable <br />contributions in a roadway. He stated the conditions for groups requesting <br />to solicit are 1) a charity recognized by the IRS, 2) permitted by the <br />police department, 3) one permit will be issued in the City for any given <br />day, 4)provide proof of general liability, 5) safety requirements such as <br />location restrictions, participants must wear reflective vests and traffic <br />cones are placed in advance of the intersection and 6) registration of all <br />persons soliciting, with no one under 18 allowed to solicit. Mr. Taylor <br />moved to amend Section 34.105(c) (2) (B) the first two sentences to read, <br />Written proof of liability insurance in the amount of at least $500,000.00 <br />per occurrence. The insurance must not have a deductible in excess of <br />$250.00 per occurrence; and Mr. Mihalkanin seconded the motion, which <br />passed unanimously.
