Texas Commission on Environmental Quality <br />AGREEMENT <br />CITY OF SAN MARCOS <br />RN100838648 <br />Enforcement Case No. 35328 <br />Hays County, Texas <br />The Texas Commission on Environmental Quality ("Commission" or "TCEQ") is the state agency <br />charged with enforcing TEx. WATER CODE ch. 26 (the "Code") and the regulations promulgated pursuant <br />to the Code. <br />The City of San Marcos ("the City") owns and operates a wastewater collection system located in Hays <br />County, Texas (the "System"). <br />The City has reported 30 unauthorized discharges during the period between January 2004 and February <br />2006. The majority of these discharges were due to infiltration/inflow problems, grease/debris blockages, <br />and power/equipment failure. The City will be required to rehabilitate the System to insure a reduction of <br />risk to the public health and the environment and to comply with Commission requirements. <br />PROVISIONS <br />In response to these deficiencies and in an effort to eliminate the potential threat to.public health, the City <br />and the Commission have entered into an Agreement. This Agreement formalizes the commitments made <br />by the City in its letter to the TCEQ dated June 7, 2007 (amended on March 21, 2008) (see Attachment <br />A). The provisions of this Agreement are as follows: <br />Immediately upon the effective date of this Agreement, the City shall continue the chemical <br />treatment for fats, oil, and grease ("FOG") and root control in the System, as described in Section <br />2 of Attachment A. The City shall provide information on the completion of corrective actions <br />regarding this program, in accordance with Provision No. 9 below. <br />2. Immediately upon the effective date of this Agreement, the City shall continue the Routine <br />Cleaning and Inspection/Maintenance/Replacement Programs, as described in Sections 3 and 4 of <br />Attachment A. The City shall provide information regarding the locations where inspections and <br />routine maintenance occurred, estimated linear feet cleaned per year, any equipment repairs, and <br />priority adjustments that were made to the cleaning schedule based on the results of the FOG <br />Program, in accordance with Provision No. 9 below. <br />Immediately upon the effective date of this Agreement, the City shall continue the plan for <br />testing, repair, or rehabilitation of collection lines that are a source of infiltration or inflow, as <br />described in Section 7 of Attachment A. The City shall provide information regarding actions <br />completed under this plan, as described in the paragraph titled "Rehabilitation Plan and Final <br />Report" of Section 7 of Attachemnt A, in accordance with Provision No. 9 below. <br />
