City of San Marcos <br />Agreement <br />Page 2 <br />4. The City shall continue the Capital Improvements Program ("CIP") projects, as shown in Table 2 <br />of Attachment A. The proposed tasks, projects, and schedule are based on the assumption of <br />adequate funding and future City Council approvals. <br />Within 90 days of the effective date of this Agreement, the City shall develop and implement a <br />FOG Control Program, as described in Section 1 of Attachment A. The City shall provide the <br />findings of sewer line inspections and completed corrective actions regarding the identification of <br />problem areas in the System, facility inspections, and establishment of and updates to the FOG <br />and Sewer Use Ordinances, in accordance with Provision No. 9 below. <br />6. Within 90 days of the effective date of this Agreement, the City shall develop and implement a <br />plan for the assessment of all lift stations to ensure adequate capacity and/or an alternative power <br />source, as described in Section 5 of Attachment A. The City shall provide information regarding <br />proposed and completed projects that address pipeline, force main, and lift station needs, in <br />accordance with Provision No. 9 below. <br />7. By December 31, 2008, the City shall develop and implement a plan to protect pipelines and <br />appurtenances that are vulnerable to vehicles and other hazards, as described in Section 6 of <br />Attachment A. The City shall provide information regarding actions completed under this plan, <br />in accordance with Provision No. 9 below. <br />The City shall evaluate the effectiveness of its corrective actions by: <br />a. Continuing the preventative maintenance plan, including manhole inspections, smoke <br />testing, internal cleaning, television inspection, and mapping; and <br />b. Periodically reviewing sewer-related calls to track changes in the amount and types of <br />blockages occurring in the System. <br />9. Within 90 days of the effective date of this Agreement, and on an annual basis thereafter, the City <br />shall submit a progress report to the Commission. These reports shall include information <br />regarding actions taken by the City towards completion of the Provisions in this Agreement. <br />10. By May 31, 2018, the City shall submit a written Final Report that contains the following: <br />A summary of all corrective actions that have been completed in accordance with the <br />Provisions in this Agreement; <br />b. A summary of all Provisions in this Agreement that were not completed, including <br />reasons why specific corrective actions were delayed; and <br />c. A description of the overall improvement the corrective actions had on the System. <br />
