exclusive use of the facilities during off peak days.

7.

Relocation of Persons or Business:

An important item usually sought in other Proposals deals with the relocation of Persons or

Business. This project requires NO person or business relocations.

8.

Overhead Utility Lines:

There are is an existing overhead primary lines along the exterior property line of Lot 3 and

traversing the middle of Lot 4 and the western edge of Lot 5 (see attached map). The overhead lines

described are transmission lines belonging to the Lower Colorado River Authority and will in all

likelihood not be relocated and or placed underground. The City of San Marcos intends to honor all

existing easements, which are borne out by the title insurance policy exchanged during the "closing"

of the property. The City of San Marcos is aware of the Program Guidelines that prohibit future

overhead utility lines. The City of San Marcos hereby acknowledges these requirements and hereby

commits to provide underground for any new utility lines including electrical primary and secondary

lines, telephone lines, cable television lines, and other such traditionally overhead utility lines,

encased in conduit as required by codes and/or the agencies providing said utility lines.

PROGRAM NARRATIVE - Page 7 of7
