• (14)MOTION: Upon a motion made by Councilmember Thomaides and a second by Councilmember Bose, the City Council voted seven (7) for and none (0) opposed, to adopt Resolution 2010-2R, as previously captioned. The motion carried unanimously. (15)MOTION: Upon a motion made by Councilmember Terry and a second by Councilmember Thomaides, with amended language proposed by the City Attorney, the City Council voted seven (7) for and none (0) opposed, to adopt Resolution 2010-3R, as previously captioned. The motion carried unanimously. (22)MOTION: Upon a motion made by Councilmember Thomaides and a second by Councilmember Thomason, the City Council voted seven (7) for and none (0) opposed, to adopt Resolution 2010-1OR, as previously captioned. The motion carried unanimously. NON-CONSENT AGENDA 27. Consider appointment of elected official to serve on the Lone Star Rail District Board. MOTION: Upon a motion made by Councilmember Bose and a second by Councilmember Terry, the City Council voted seven (7) for and none (0) opposed, to appoint Councilmember John Thomaides to the Lone Star Rail District Board. The motion carried unanimously. is 28. Consider an ordinance amending Article 3. Taxicabs, of Chapter 90, Vehicles for Hire, of the San Marcos City Code to update, expand and clarify city regulations for taxicabs; adding provisions regulating pedicabs; setting maximum taxicab fares and charges; including procedural provisions and declaring an effective date; and consider ordinance on first of two readings. MOTION: Upon a motion made by Councilmember Jones and a second by Councilmember Porterfield, the City Council voted seven (7) for and none (0) opposed, to adopt the ordinance on the first of two readings. The motion carried unanimously. 29. Consider an ordinance amending Chapter 18, Businesses, Article 6, Sexually Oriented Businesses, of the San Marcos City Code to change definitions and location requirements; providing for penalties, and, including procedural provisions; and consider ordinance on first of two readings. MOTION: Upon a motion made by Councilmember Jones and a second by Councilmember Thomaides, the City Council voted seven (7) for and none (0) opposed, to table this ordinance in order to extend the moratorium at the January 19 meeting. The motion carried unanimously. The City Council provided direction to staff to bring back to Council information on 1) a notification process and public hearing forum; 2) answers to enforcement concerns; and 3) publication of the proposed zoning map and update to citizens comparing the difference between • the current ordinance and the proposed draft ordinance.
