THE STATE OF TEXAS <br />COUNTY OF HAYS <br />Contract No. <br />SUBRECIPIENT AGREEMENT <br />ENERGY EFFICIENCY AND CONSERVATION BLOCK GRANT PROGRAM <br />This Agreement, is made and entered into on this 19th day of January, 2010, between the City of San <br />Marcos (the "City"), 630 East Hopkins, San Marcos, Texas, and Combined Community Action (the <br />"Subrecipient"), 165 W. Austin, Giddings, Texas 78942. <br />WITNESSETH THAT: <br />WHEREAS, the Subrecipient desires to carry out eligible activities as described in the Statement <br />of Work (the "Project"), attached to and incorporated into this Agreement as Exhibit "A", pursuant to the <br />U.S. Department of Energy ("DOE") Energy Efficiency and Conservation Block Grant ("EECBG") <br />Program; <br />WHEREAS, the City has been awarded grant funds which may be spent by the City for the <br />provision of certain services authorized under the EECBG Program and it wishes to engage the <br />Subrecipient to provide these services to the San Marcos community; <br />Now therefore, the City and Subrecipient agree as follows: <br />ARTICLE 1 <br />SUBRECIPIENT'S RESPONSIBILITIES <br />1.1 Subrecipient acknowledges that funds granted to the Subrecipient by the City under this <br />Agreement have been granted to the City pursuant to DOE's EECBG Program. <br />1.2 The Subrecipient certifies that it is authorized to receive EECBG Program funds, and that it is not <br />on the Federal "Excluded Parties" listing system. <br />1.3 The Subrecipient agrees to cooperate fully with the City in respect to the implementation of the <br />EECBG Program activities to be carried out by the Subrecipient, and other rules, regulations and <br />decisions as may be made by the DOE or any other federal or state agency that may legally exercise its <br />jurisdiction over expenditures of EECBG funds. <br />1.4 Subrecipient agrees to qualify beneficiaries for grant funding based on income level. Households <br />at or below 200% of the poverty level are considered low-income and qualify for funding through this <br />program. Subrecipient agrees to obtain and verify documentation of income eligibility of beneficiaries. <br />1.5 Subrecipient agrees to verify that 100% of the qualified beneficiaries for which funding is provided <br />by the City reside within the San Marcos city limits. <br />1.6 Subrecipient understands that it is solely responsible for meeting the terms and conditions of this <br />Agreement. If Subrecipient fails to properly perform or complete any of the work specified in the <br />Statement of Work, it will not receive grant funding for any work that is found to be improperly performed <br />or incomplete.
