34. Regular Meeting November 10, 2003 Page 3 Mayor Habingreither introduced for consideration three appointments to the Youth Commission. No nominations were received and these appointments will be rescheduled. Mayor Habingreither introduced for consideration one appointment to the Economic Development Council. Ms. Narvaiz moved to appoint Dan Roy as City Resident, which pasBed unanimously. Mayor Habingreither introduced a presentation by the Clean Air Force. Bill Gill with the Clean Air Force gave a presentation to Council regarding the Early Action Compact/Clean Air Plan. He stated the EPA looks at 3 year period of time. He stated in 2003 the City barely stayed in compliance in August. He stated the City will have to actively work on staying below the ozone levels. He reviewed the value of attainment of improved public health and healthy economy. He also stated Toyota located in San Antonio over Dallas because Dallas is a non-attainment area. He also discussed the recommended measures of inclusion in the Clean Air Action Plan. Mr. O'Leary stated the City may need to consider having stricter inspection standards, which will need to be approved by the Council, County Judge and Commissioners. Mr. Mihalkanin inquired when a plan would need to be submitted. Mr. Gill stated a Plan will need to be submitted by March 31, 2004. He stated a draft plan will need to be submitted to TCEQ by January 31, 2004. He also stated if the Plan is approved it will be good until 2007. Mr. Mihalkanin asked for this item to be on the next agenda as an action item. Ms. Narvaiz asked for Staff to contact the County to see where they stand on this issue. Mayor Habingreither introduced for consideration adoption of an Ordinance on emergency, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING A REVISED SCHEDULE OF WHOLESALE WATER TREATMENT RATES AND TERMS AND CONDITIONS TO INCREASE THE CITY'S WHOLESALE WATER TREATMENT RATE; AND INCLUDING PROCEDURAL PROVISIONS. Mayor Habingreither opened the public hearing and asked if anyone wished to speak. No one did, so Mayor Habingreither closed the public hearing. Ms. Narvaiz moved to approve the Ordinance on first reading and Mr. Thomaides seconded the motion, which passed unanimously. Mayor Habingreither introduced for consideration adoption of an Ordinance on emergency, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AUTHORIZING THE ISSUANCE AND SALE OF CITY OF SAN MARCOS, TEXAS, WATERWORKS AND WASTEWATER SYSTEM REVENUE BONDS, SERIES 2003; PROVIDING FOR THE SECURITY FOR AND PAYMENT OF SAID BONDS; PRESCRIBING THE FORM OF SAID BONDS; AWARDING THE SALE THEREOF; APPROVING THE OFFICIAL STATEMENT; ENACTING OTHER PROVISIONS RELATING TO THE SUBJECT; AND DECLARING AN EMERGENCY (in the amount of $5,130,000.00).
