All parties to the proceeding were properly notified before the special commissioners. <br />The special commissioners find: <br />1. Cn November 9, 2007, Plaintiff f led a written petition with the Clerk of the <br />County Court at Law, Hays County, Texas, seeking judgment for acquisition of a 9.5801-acre <br />tract and a 0.1722-acre tract described as follows: <br />4 <br />SEE ATTACHED EXHIBIT -"A". <br />2. 4n November 13, 2007, Howard S. Warner, iI, Judge of the County Court at Law, <br />Hays County, Texas, appointed Ronnie Beasley, John Ferguson, and Bill Daniels, three ~3} <br />disinterested freeholders of Hays County, Texas, as special commissioners to assess the, damages <br />resulting from this eminent domain proceeding. <br />3. These special commissioners were duly qualified, and each took the oath prescribed <br />by law in which each swore to assess the damages fairly and impartially and in accordance with <br />law. Copies of these oaths are on file with the papers in this proceeding. <br />4. The special commissioners promptly set January 3, 2008, at 10:00 o'clock a.m., at <br />the San Marcos Activity Center, Meeting Room No. 3, 50I E. Hopkins, San Marcos, Texas 786b6, <br />as the time and place far hearing. <br />The day appointed was the earliest practicable day, and the place selected was in the county <br />seat of the county in which the property is situated. <br />5. Notice in writing was issued by the commissioners to each of the parties <br />.:~ <br />.~ <br />interested, notifying them of the time and place selected for the hearing. <br />5.
