<br />176 <br /> <br />RESOLUTION 1987-96R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, DECLARING THE <br />NECESSITY OF ACQUIRING REAL PROPERTY FOR <br />A PUBLIC PURPOSE, TO-WIT: TO FACILITATE <br />THE PROPER ALIGNMENT OF NORTH L.B.J. <br />DRIVE AND BISHOP STREET AT RANCH ROAD 12~ <br />AUTHORIZING AND DIRECTING THE CITY <br />ATTORNEY TO ACQUIRE SUCH PROPERTY THROUGH <br />VOLUNTARY ACQUISITION OR TO INSTITUTE <br />EMINENT DOMAIN PROCEEDINGS THEREFOR~ AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />WHEREAS, it is necessary that. the City of San Marcos, <br />Texas, acquire fee simple title to a 0.171 acre tract of <br />land, being out of a part of that most westerly portion of a <br />1.83 acre tract. of land out of the Elijah Clark Survey No. <br />Eleven (11) in Hays County, Texas, which was conveyed to R.F. <br />Sowell Jr., and wife, Jane H. Sowell by deed dated July 1, <br />1955 and recorded in Volume 164, Page 254 of the Deed Records <br />of Hays County, Texas, said 0.171 acre tract being more <br />particularly described in Exhibit A which is attached hereto <br />and made a part hereof for all purposes, for a public <br />purpose, to-wit: to facilitate the proper alignment of North <br />L.B.J. Drive and Bishop Street at Ranch Road l2~ and, <br /> <br />WHEREAS, the City Council of the City of San Marcos, <br />Texas, hereby finds that the acquisition of such property is <br />in the interest and the benefit of the citizens of San <br />Marcos, Texas~ now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br /> <br />PART 1. Tha t a publ ic purpose, to-wi t: the proper <br />alignment of North L.B.J. Drive and Bishop Street at Ranch <br />Road 12, exists which makes necessary the acquisition by the <br />City of an approximately 0.171 acre tract of land, being out <br />of a part of that most westerly portion of a 1.83 acre tract <br />of land out of the Eli jah Clark Survey No. Eleven (11) in <br />Hays County, Texas, which was conveyed to R. F. Sowell Jr., <br />and wife, Jane H. Sowell by deed dated July 1, 1955 and <br />recorded in Volume 164, Page 254 of the Deed Records of Hays <br />County, Texas, and being more particularly described in <br />Exhibit. A att.ached hereto and made a part hereof for all <br />purposes. <br /> <br />PART 2. That the Ci t.y Att.orney is hereby authorized <br />and directed to acquire through voluntary acquisi t_ion or to <br />institute eminent domain proceedings for said 0.171 acre <br />tract of land. <br /> <br />PART 3.
