176 RESOLUTION 1987-96R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, DECLARING THE NECESSITY OF ACQUIRING REAL PROPERTY FOR A PUBLIC PURPOSE, TO-WIT: TO FACILITATE THE PROPER ALIGNMENT OF NORTH L.B.J. DRIVE AND BISHOP STREET AT RANCH ROAD 12~ AUTHORIZING AND DIRECTING THE CITY ATTORNEY TO ACQUIRE SUCH PROPERTY THROUGH VOLUNTARY ACQUISITION OR TO INSTITUTE EMINENT DOMAIN PROCEEDINGS THEREFOR~ AND DECLARING AN EFFECTIVE DATE. WHEREAS, it is necessary that. the City of San Marcos, Texas, acquire fee simple title to a 0.171 acre tract of land, being out of a part of that most westerly portion of a 1.83 acre tract. of land out of the Elijah Clark Survey No. Eleven (11) in Hays County, Texas, which was conveyed to R.F. Sowell Jr., and wife, Jane H. Sowell by deed dated July 1, 1955 and recorded in Volume 164, Page 254 of the Deed Records of Hays County, Texas, said 0.171 acre tract being more particularly described in Exhibit A which is attached hereto and made a part hereof for all purposes, for a public purpose, to-wit: to facilitate the proper alignment of North L.B.J. Drive and Bishop Street at Ranch Road l2~ and, WHEREAS, the City Council of the City of San Marcos, Texas, hereby finds that the acquisition of such property is in the interest and the benefit of the citizens of San Marcos, Texas~ now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. Tha t a publ ic purpose, to-wi t: the proper alignment of North L.B.J. Drive and Bishop Street at Ranch Road 12, exists which makes necessary the acquisition by the City of an approximately 0.171 acre tract of land, being out of a part of that most westerly portion of a 1.83 acre tract of land out of the Eli jah Clark Survey No. Eleven (11) in Hays County, Texas, which was conveyed to R. F. Sowell Jr., and wife, Jane H. Sowell by deed dated July 1, 1955 and recorded in Volume 164, Page 254 of the Deed Records of Hays County, Texas, and being more particularly described in Exhibit. A att.ached hereto and made a part hereof for all purposes. PART 2. That the Ci t.y Att.orney is hereby authorized and directed to acquire through voluntary acquisi t_ion or to institute eminent domain proceedings for said 0.171 acre tract of land. PART 3.
