<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS AMENDING SECTION 3 OF THAT ORDINANCE
<br />WHICH REGULATES AND RESTRICTS THE LOCATION AND USE OF
<br />BUILDINGS, STRUCTURES AND LAND, DATED JUNE 13, 1984
<br />(VOLUME 66) BY CHANGING THE ZONING OF 199.62 ACRES, MORE
<br />OR LESS, OF LAND IN THE J.M. VERAMENDI LEAGUE NO.1,
<br />A-17 AND THE JAMES CURTIS SURVEY A-3, HAYS COUNTY,
<br />TEXAS, FROM BEING UNZONED AND "PD" (PRE-DEVELOPMENT
<br />DISTRICT) TO "PDD" (PLANNED DEVELOPMENT DISTRICT);
<br />APPROVING A PDD DEVELOPMENT PLAN FOR SAID 199.62 ACRE
<br />TRACT; APPROVING A SITE PLAN FOR SAID 199.62 ACRE
<br />TRACT IN ACCORDANCE WITH CHAPTER 36, SAN MARCOS RIVER
<br />CORRIDOR, OF THE CODE OF ORDINANCES OF SAID CITY;
<br />AND DECLARING AN EFFECTIVE DATE.
<br />
<br />WHEREAS, on May 20,1986, the Joint Planning and Zoning Commission
<br />of the City of San Marcos held a public hearing regarding a request to
<br />change the zoning from "PD" (Pre-Development District) to "PDD"
<br />(Planned Development District) of 57.67 acres of land in the J.M.
<br />Veramendi League No.1, A-17 and the James Curtis Survey A-13, said
<br />land being located in San Marcos, Hays County, Texas; and,
<br />
<br />WHEREAS, subsequent to said public hearing on said date, said
<br />Commissions did, on May 20,1986, consider said request and the Zoning
<br />Commission voted to approve the same and has recommended that said
<br />request be approved by the City Council of said City; and,
<br />
<br />WHEREAS, on, September 2,1986, the Zoning Commission of the City
<br />of San Marcos held a public hearing regarding a request to zone 141.95
<br />acres, more or less of previously unzoned land in the J.M. Veramendi
<br />League No.1, A-17 and the James Curtis Survey A-13 to "PDD" (Planned
<br />Development District) said land being located in San Marcos, Hays
<br />County, Texas; and,
<br />
<br />WHEREAS, subsequent to said public hearing on said date, said
<br />Commissions did, on September 2,1986, consider said request and the
<br />Zoning Commission voted to approve the same and has recommended
<br />that said request be approved by the City Council of said City; and,
<br />
<br />WHEREAS, said City Council held a public hearing on the
<br />March, 1987, regarding said requests; and,
<br />
<br />23 day of

<br />WHEREAS, all requirements of Appendix A, General Zoning Ordinance
<br />of the Code of Ordinances of the City of San Marcos pertaining to
<br />amendments have been met; and,
<br />
<br />WHEREAS, Section 400, Chapter 35, Comprehensive Development Code,
<br />of the Code of Ordinances of the City of San Marcos empowers the
<br />Planning and Zoning Commissions of the City of San Marcos to recommend
<br />approval of a PDD Development Plan.

<br />WHEREAS, on May 20, 1986, the Zoning Commission of said City
<br />recommended approval of a PDD Development Plan for said 57.67 acre
<br />tract of land in the J.M. Veramendi League No.1, A-17 and the James
<br />Curtis Survey A~3; and,
<br />
<br />WHEREAS, on May 20, 1986 the Planning Commission of said City
<br />recommended approval of a PDD Development Plan for a 141.95 acre tract
<br />of land in the J.M. Veramendi League No.1, A-17 and the James Curtis
<br />Survey A-3; and,
<br />
<br />WHEREAS, on May 20, 1986, the Zoning Commission recommended
<br />approval by the City Council of a SMRC Site Plan for said 57.67 acre
<br />tract of land in the J.M. Veramendi League No.1, A-I7 and the James
<br />Curtis Survey A-3, in accordance with Section 2, Chapter 36, San Marcos
<br />River Corridor, of the Code of Ordinances of said City; and,
<br />
<br />WHEREAS, on September 2,1986, the Zoning Commission recommended
<br />approval by the City Council of a SMRC Site Plan for said 141.95 acre
<br />tract of land in the J.M. Veramendi League No.1, A-17 and the James
<br />Curtis Survey A-3, in accordance with Section 2, Chapter 36, San Marcos
<br />River Corridor, of the Code of Ordinances of said City; and,
<br />
<br />WHEREAS, said City Council hereby finds and
<br />
<br />determines
