ARTICLE I DEFINITIONS AND OTHER PRELIMINARY MATTERS Section 1.01. Definitions. Unless otherwise expressly provided or unless the context clearly requires otherwise, in this Ordinance, the foHowing terms shaH have the meanings specified below: "Additional Bonds" means the additional parity revenue bonds and obligations permitted to be issued under the provisions of this Ordinance and the Ordinances authorizing the Outstanding Bonds. "Bond" means any of the Bonds. "Bondholder" or "Holder" or "Owner" means the person who is the registered owner of a Bond or Bonds, as shown in the Register. "Bond Insurer" means Financial Guaranty Insurance Company, a New York stock insurance corporation, and its successors. "Bonds" means the City's bonds entitled "City of San Marcos, Texas, Combination Tax and Revenue Refunding Bonds, Series 1987" in aggregate principal amount of $6,680,000 authorized to be issued by Section 3.01 of this Ordinance. "Charter" means the Home Rule Charter of the City as amended. "Closing Date" means the date of the initial delivery of and payment for the Bonds. "Code" means the Internal Revenue Code of 1986, including the regulations and published rulings thereunder. "Escrow Agent" means MBank Austin, N.A., Austin, Texas. "Escrow Agreement" means the escrow agreement, dated as of April 2, 1987, by and between the City and MBank Austin, N.A., Austin, Texas, as escrow agent. "Escrow Fund" means the fund referred to in Sections 7.02(ii) and 14.02 of this Ordinance and established by the Escrow Agreement to hold cash and securities for the payment of and interest on the Refunded Obligations. "Event of Default" means any Event of Default as defined in Section 10.01 of this Ordinance. "Initial Bond" means the bond described in Section 6.02(d) of this Ordinance. "Initial Date" means the date designated as the Initial Date by Section 3.02(a) of this Ordinance. 1659f -2-
